MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 8th JULY, 2002 AT 7.30 P.M.
IN THE COONFERENCE ROOM, TOWN HALL.

PRESENT: Chairman: Cllr W Prior
Vice Chairman: Cllr Mrs. M Curtis
Councillors: E Bannister, Mrs. E Downes, A Josselyn, Mrs. S Riesebeck, K Smith and S Thain.
In Attendance: The Town Clerk, Planning Committee Clerk and one member of the public.
32. APOLOGIES FOR ABSENCE
An apology for absence was received from Cllr. Mrs. V Foster.
33. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 25TH JUNE 2002

Members received the minutes of the Planning Committee meeting held on 25th June 2002.

Minute 31 - Traffic Regulation Orders
Cllr Prior made reference to the third paragraph of minute 31 stating that this needed to be amended as the meaning intended had been lost. In view of this Cllr Prior detailed the amendments to be made.

RESOLVED: that (a) the following amendments as shown in bold be made to minute 31, third paragraph:

Cllr Prior informed members that he had been making enquiries as to whether any recent traffic surveys had been undertaken with regard to the present systems WITHIN THE TOWN and the reasoning behind the proposed changes to the PRESENT SYSTEM but there was no evidence of such a survey having been carried out RECENTLY.

(b) in all other respects the minutes of the Planning Committee meeting held on 25th June 2002 be approved.
34. PLANNING APPLICATIONS
Members received and considered planning applications for weeks ended:
  a. 28th June, 2002

1. LBC/MAL/02/00667 MALDON NORTH WEST

Installation of handrails to front door.
Old Court House, London Road, Maldon
Mr. and Mrs. A Want

Cllr Mrs. Downes declared a non pecuniary interest in the above application and took no part in the discussion.

RESOLVED: that the Town Council has no objection to this application.
2. FUL/MAL/02/00670 MALDON SOUTH

First floor side extension.
21 Belvedere Place, Maldon
Mr. and Mrs. Blackbord

RESOLVED: that the Town Council has no objection to this application.
  b. 5th July, 2002

3. FUL/MAL/02/00686 MALDON NORTH WEST

Change of use from Class B1 (Business) to use for the storage and trade hire of building equipment with ancillary sales of equipment and consumables.
Unit 1 Riverside Industrial Estate, Mill Lane

RESOLVED: that the Town Council has no objection to this application. Members felt that the proposed new tenants of this site should be requested to adhere to the no right turn traffic order, exiting from Mill Road.
   4. FUL/MAL/02/00691 MALDON NORTH WEST

Erection of office block B1 use and maintenance store and associated car parking (amended proposal for revised means of access).
Site off Station Road, Maldon

RESOLVED: that the Town Council has no objection to this application.
   5. FUL/MAL/02/00694 MALDON NORTH WEST

Application for non-compliance with condition 4 of planning permission FUL/MAL/00/01087 concerning car parking provision.
Bates Motors, 36 Spital Road, Maldon
Cooper Maldon

RESOLVED: that the Town Council has no objection to this application.
35. CONSIDERATION AND DETERMINATION OF PLANNING APPLICATIONS

Further to minute 25.3 of the Council meeting held on 24th June 2002, members reconsidered the letter dated 3rd May 2002 from C Tokely, Chief Planning and Development Officer, Maldon District Council.

Cllr Thain stated that the letter indicated three response options, object, no objection and support, and he felt the response support should only be used when the Town Council was positive and fully in support of an application.

Cllr Bannister felt that the response should be support or object.

Cllr Josselyn felt that there were four response options with 'no comment' being used if the application was beyond the expertise of the Planning Committee.

Discussion ensued regarding this matter and it was

RECOMMENDED: that a letter be forwarded to Mr. C Tokley requesting clarification as to the action that would be taken if the Town Council continued to use the wording 'no objection' in response to applications.
36. PUBLIC SPEAKING AT MEETINGS

Further to minute 9 of the Planning Committee meeting held on 27th May 2002, members received the following response from Cllr R Bass, Leader of the (Maldon District) Council.

I am sorry but I do not understand the views of your members. A Green Paper is by definition a consultation paper issued by the Government i.e. one on which views are sought. We have responded to it as a consultee which is surely our right.

Maldon District Council has a long established policy which does not allow the public to speak at meetings - particularly planning committee meetings. Although the present Government is highly dictatorial and centralist in its views on how local authorities should operate, I doubt whether even it would legislate to make public participation at meetings a requirement in law. If it proposed such legislation we would oppose it.

In answer to a question from Cllr Josselyn the Town Clerk outlined the background relating to this matter.

RECOMMENDED: that the information be noted.
37. TOWN AND COUNTRY PLANNING ACT 1990
APPEAL BY MR. & MRS. FENTON
SITE AT 3 RANDOLPH CLOSE, MALDON, ESSEX

Notification had been received that the Planning Inspectorate had allowed the above appeal. Members recalled that the Town Council had no objection to this application.

RECOMMENDED: that the information be noted.
38. ALL PARTY SELECT COMMITTEE ON TRANSPORT, LOCAL GOVERNMENT AND THE REGIONS - REPORT ON THE CONCLUSIONS AND RECOMMENDATIONS OF THE PLANNING GREEN PAPER

Members received and considered the above document regarding the Planning Green Paper.

It was noted that the original intention of the Green Paper was to speed up the Planning system, make it more efficient and involve greater consultation however, these objectives conflict and the document states that 'the Governments' proposals are unworkable as a whole'. Further information will be forthcoming in due course.

RECOMMENDED: that the information be noted.
At the conclusion of the meeting Cllr Prior informed members that he had attended a Planning training day on 6th July and he circulated a paper entitled 'Procedures for Effective Planning Decision Making' it was noted that a report on his attendance at the Planning training day would be included on the agenda for the next Planning meeting.
