MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 6th AUGUST, 2002 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

The Chairman welcomed Cllr S Savage to the meeting and said that although he was unable to vote he could take part in discussions.

Members felt that the proposed storage buildings although not in the Promenade Park would be seen from the park. Cllr Thain proposed and Cllr Mrs. Curtis seconded that the Friends of the Prom should be consulted regarding this application.

RESOLVED: that the Town Council is of the opinion that the style of construction is not sympathetic with the Park and it is felt that the Friends of the Prom should be consulted on the application.

c.9 FUL/MAL/02/00791 HEYBRIDGE

Full Application
Development of land for residential and open space use together with extension of Maldon By-pass, site access and site contouring without complying with condition 2 and 5 of OUT/MAL/92/0703. Permission is sought to extend the period for submission of landscaping details of Phase 5 to 10 years from the date of the outline.

The Town Clerk informed members that this application was to extend the period of time to submit reserved matters such as landscaping as the outline approval granted in 1994 for 7 years had expired in February 2001. Members noted that this site was within the flood plain and had originally been allocated as a school site but the Essex County Council had not purchased the land. Discussion ensued and it was

RESOLVED: that the Town Council objects to this application and any development in this area because the site is located within a flood plain and taking into consideration the Flood Risk Assessment circulated with the application it is felt the area could still flood and in this respect reference is made to Policy M/CON/l of the Maldon District Draft Replacement Local Plan. Reference is also made to PPG25. There is a lack of infrastructure in Heybridge i.e. health care facilities, schools. If this application does proceed landscaping at the Elizabeth Way Play area should include raised areas so that it is still usable if flooding does occur.

It was noted that the amendment included change to the roof over the proposed extension so that it would no longer overhang the adjacent property.
Members were reminded that at the Planning Committee meeting 25th June 2002 they had no objection.

12. ADV/MAL/02/00628 MALDON SOUTH

It was noted that the amendment included removal of internal illumination, in order to protect the character of the conservation area.
Members were reminded that at the Planning Committee meeting 25th June 2002 they had no objection subject to the approval of the District Council Officer.

13. FUL/MAL/02/00619 MALDON EAST

Proposed conversion of existing agricultural building to offices and alterations.

It was noted that the amendment included revised plans at the local planning authorities request to show landscaping, passing bays and weather boarding on Eastern element.
Members were reminded that at the Planning Committee meeting 25th June 2002 they had no objection.

14. FUL/MAL/02/00185 MALDON NORTH WEST

Full / Conservation Area Consent
Demolition of existing car sales showroom. Erection of 12 no 2 bedroom houses and 2 no 2 bedroom maisonettes and minor alteration to existing access.

CENTRAL AREA COMMITTEE

It was noted that the amendment included revised pitch for roofs of garages. They were proposed to be reduced to 35 degrees.
Members were reminded that at the Planning Committee meeting 7th May 2002 the Town Council objected to this application, members expressed serious concerns with regard to the Ware Pond regarding its spring water feed and damage caused by heavy construction vehicles. Members suggest that the retaining wall be in place before work commences. Members object to the proposed accommodation being for mature people as there is a lack of low cost housing for young people (item 5.11 and 5.12 of the planning statement) and support item 4.7 which refers to PPG3.

Cllr Mrs. Curtis declared an interest in the above application and took no part in the discussion.

RESOLVED: that the District Council be informed that from the plan members could not see what the minor alteration to the existing access was.
50. MONTHLY LIST OF PLANNING DECISIONS UP TO WEEK ENDING 19TH JULY 2002

Members received the monthly list of Planning Decisions for week ending 19th July 2002.

The Chairman felt that it would be beneficial to include the previous comments of the Town Council regarding each application on the list of decisions.

RECOMMENDED: that
(a) the views of the Town Council be included on the list of decisions for each application;
(b) in all other respects the information be noted.
51. PLANNING ENFORCEMENT SYSTEM

Members received a note from the Maldon Parishes Group Liaison meeting regarding the Planning Enforcement System.

RECOMMENDED: that the information be noted.
52. MALDON'S FUTURE: A COMMUNITY VIEW

Members considered the content of the above booklet which had previously been circulated to all members of the Council.

Members agreed that this was an excellent document and it was reported that Maldon's Future: A Community View was compiled by residents of Maldon and reflects the community view. Reference was made to the fact that the booklet had been printed after the Maldon District Draft Replacement Local Plan had been compiled however, it was reported that the text of the document had been forwarded to officers at the District Council prior to the plan being released. It still may be possible for sections of the booklet to be adopted as Supplementary Planning Guidance. It was felt that the section regarding traffic and parking contained good ideas.

RECOMMENDED: that the information be noted.
53. TRAFFIC CALMING MILL ROAD

Further to minute 31 of the Planning Committee meeting held on 25th June 2002, members recalled that it was agreed that a request be forwarded to the Essex County Council for the installation of traffic calming measures in Wantz Road prior to the revocation works being undertaken.

Information had been received from Mr. S Broad, Transportation and Operational Services, Essex County Council that it would not be possible to install traffic calming measures prior to the revocation of the traffic Regulation Order. Traffic volumes and speeds would be monitored before and after the revocation to ascertain the effect it has had and traffic calming measures would be considered if speeds are shown to have increased. Following a telephone conversation with Mr. Broad, Cllr Thain reported that Mr. Broad would provide the raw data of the traffic survey if requested to do so.

Further information had been received from Mr. S Broad stating the following;

I know of no sign that I can install on the highway giving priority to buses, other than on a bus lane. However, if drivers revert to using Wantz Road the problems in Mill Road should reduce. The result of the changes in Wantz Road will be closely monitored, but any feedback from your members will be much appreciated.

The Chairman informed members that he had contacted Mr. Broad enquiring when the last full traffic survey had been carried out in the town. Mr. Broad said such a survey had not been undertaken for some considerable time and was not planned for the future.

It was felt that the Traffic Order in Wantz Road had created a nice environment in that area and Mill Road will continue to be a problem. Cllr Thain said that the Town Council could include money in budget for traffic calming measures and he proposed that the Town Council should consider preparing a ten year plan to improve traffic management, this was seconded by Cllr Mrs. M Curtis and carried when put to the vote. Cllr Thain also felt that the Town Council should resist the removal of residents parking in Wantz Road as this creates traffic calming.

RECOMMENDED: that
(a) a letter be forwarded to Mr. S Broad, Transportation and Operational Services, Essex County Council requesting the raw data of the traffic monitoring in Mill Road/Wantz Road;
(b) the Town Council considers a 10 year plan to improve traffic management within the town.

 54. FELLING OF ONE PURPLE LEAFED SYCAMORE TREE, DEED HOUSE, 21 LONDON ROAD, MALDON

Further to minute 209.b.9 of the Planning Committee meeting held on 7th May 2002, members received correspondence from Nigel Cowling, Landscape Officer, Maldon District Council regarding the above.

RECOMMENDED: that the information be noted.
 55. RED HORSE CHESTNUT - ST PETERS NURSING HOME

Further to minute 11 of the Planning Committee meeting held on 27th May 2002, members received correspondence from Nigel Cowling, Landscape Officer, Maldon District Council regarding the above.

RECOMMENDED: that the information be noted.
 56. ESTUARIES RESEARCH PROGRAMME

Further to minute 199 of the Planning Committee meeting held on April 15th 2002, members received correspondence and minutes from Mr D Brew, Senior Coastal Geomorphologist, Royal Haskoning regarding the Blackwater Consultation Workshop held on the 9th April attended by Cllrs E Bannister and S Thain.

Cllr S Thain confirmed that the minutes of the Blackwater Consultation Workshop reflected the meeting.

RECOMMENDED: that the information be noted.
 57. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY: Tesco Stores Ltd

APPLICATION REFERENCE NO: ADV/MAL/02/00179; ADV/MAL/01/00180

DESCRIPTION OF DEVELOPMENT: Install internally non-illuminated canopy signs and internally illuminated fascia sign to petrol filling station;
Install 2no. internally illuminated gantry signs relating to adjacent supermarket and petrol filling station.

Notification had been received from the Maldon District Council that an appeal had been made to the Secretary of State in respect of the above site against the decision of the District Council to refuse planning permission. The appeals would be decided following a hearing and the Council would be advised of the date and location of the hearing nearer the time.

Members recalled that the Town Council had no objection to this application subject to the approval of the District Council Officer.

RECOMMENDED: that the information be noted.
 58. JUSTICES

Notification had been received that Jason Gavin Clark of Richmond Road, Wickford, Essex and Peter Robert Maughan of Lucas Avenue, Moulsham, Chelmsford Essex were to apply for a full Justices Off-License to replace the existing Off-License which is limited to beer, cider and wine only, in repect of Iceland, 62-66 High Street, Maldon, Essex at the Courthouse, Newland Street on Monday 12th August 2002 at 10am.

RECOMMENDED: that the information be noted.
