MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 19th AUGUST, 2002 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

The Chairman welcomed Cllr S Savage to the meeting and said that although he was unable to vote he could take part in discussions.

An apology for absence was received from Cllr S Thain.
 60. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 6TH AUGUST 2002

Minute 53 - Traffic Calming - Mill Road
Cllr Prior made reference to minute 53 stating that this needed to be amended and it was

RESOLVED: that (a) the following amended minute 53 replace the previous minute 53;

53. Traffic Calming Mill Road

Further to minute 31 of the Planning Committee meeting held on 25th June, 2002, members recalled that it was agreed that a request be forwarded to the Essex County Council for the installation of traffic calming measures in Wantz Road prior to the revocation works being undertaken.

Information had been received from Mr. S. Broad, Transportation and Operational Services, Essex County Council that it would not be possible to install traffic calming measures prior to the revocation of the traffic Regulation Order. Traffic volumes and speeds would be monitored before and after the revocation of the one way system in Wantz Road to ascertain the effect it has had.

Following a telephone conversation with Mr. Broad, Cllr. Thain reported that Mr. Broad would provide the raw data of the traffic survey if requested to do so.

Further information had been received from Mr. S. Broad stating the following:

I know of no sign that I can install on the highway giving priority to buses, other than on a bus lane. However, if drivers revert to using Wantz Road the problems in Mill Road should reduce. The result of the changes in Wantz Road will be closely monitored, but any feedback from your members will be much appreciated.

The Chairman informed members that he had contacted Essex County Council
Highways enquiring when the last full traffic survey had been carried out in the town,
such a survey had not been undertaken for some considerable time and was not
planned until all present works within the town had been completed.

Traffic calming measures could be installed if the traffic survey shows they are necessary and would then be considered in the new financial year 2003.

(b) subject to the above amendments the minutes be confirmed and signed.

Members noted that due to the installation of an updated computer package at the Maldon District Council applications were unable to be registered and lists compiled for the week ending 9th August. A two week list was circulated at the meeting for the week ending 16th August 2002

Amendment included revision to and provision of additional car parking and details of cross sections through the site.
Members were reminded that at the Planning Committee meeting held on 19th February 2002 the Town Council objected to this application because of the overall height of the three storey building. Members felt that an artists impression would be useful regarding the visual impact of the three storey building and there should be conditions imposed regarding the protection of the pond and surrounding area, and the Willow trees; members also noted that drainage from the car park area was not indicated on the plan.

Members were reminded that at the Planning Committee meeting held on 25th June 2002 they had no objection to the application.

RESOLVED: that the Town Council has no objection to the amendments.
 62. LIST OF PLANNING DECISIONS UP TO 16TH AUGUST 2002
Members received the list of Planning Decisions for week ending 2nd August 2002; the list week ending 16th August was circulated at the meeting.

RECOMMENDED: that the information be noted.
 63. CONSIDERATION AND DETERMINATION OF PLANNING APPLICATIONS
Further to minute 35 of the Planning Committee meeting held on 8th July 2002, members received and considered correspondence from Mr. C Tokley, Chief Planning and Development Officer, Maldon District Council regarding responses to planning applications. Discussion ensued during which members expressed the view that they should continue to respond to planning applications as previously. In view of this it was

RECOMMENDED: that the Town Council respond to the Maldon District Council using the following comments: object, no objection and support (when fully in support of the application).
 64. PROPOSED AUDIT AND ASSESSMENT OF THE PLANNING SERVICE, TO ASSESS THE CURRENT LEVEL OF SERVICE AND TO INSTALL A PROGRAMME OF CONTINUED IMPROVEMENT
Members received and considered correspondence from Leigh Palmer, Area Planning Officer, Maldon District Council requesting the attendance of the Chairman an/or a representative at a meeting to be held at the District Council Offices on 29th August 2002 at 10.00am. Discussion ensued regarding items to be raised at the meeting during which reference was made to the fact that in some parts of the Country Town/Parish Councils have been delegated powers to determine some planning applications. It was felt that this was something that should be pursued in the future.

RECOMMENDED: that (a) the Chairman and Planning Committee Clerk attend the above meeting;
(b) that the Chairman submits a report at the Planning Committee meeting to be held on 2nd September 2002 on his attendance at the above meeting.
 65. CONSOLIDATION OF DEFINITIVE MAP
Members noted that a letter had been received from Mr. G White, Senior Rights of Way Officer, Essex County Council inviting members to attend a definitive map seminar. Cllr Kelly would be attending the seminar to be held on Tuesday 19th November at Channels, Little Waltham 9.30 - 12.00 noon. As Town Council Parish Paths representative he would receive the new definitive plan on behalf of the Town Council; members noted that a further two places were available.
RECOMMENDED: that the information be noted.
 66. DATES OF MEETINGS OF THE CENTRAL AREA PLANNING COMMITTEE
Members received correspondence from Stuart Elrick, Head of Corporate Services, Maldon District Council regarding revised dates of meetings for the remainder of the Municipal Year.

RECOMMENDED: that the information be noted.
 67. PLANNING: THE ROLE OF TOWN AND PARISH COUNCILS
Members received a copy letter from the Chief Executive of the National Association of Local Councils sent to Lord Rooker regarding the role of Town and Parish Councils.

RECOMMENDED: that the information be noted.
 68. TOWN AND COUNTRY PLANNING ACT 1990
THE DISTRICT COUNCIL OF MALDON TREE PRESERVATION ORDER NO.1/95 - THIRD SCHEDULE
APPEAL AGAINST THE REFUSAL OF CONSENT TO REDUCE THE CROWN OF ONE HOLM OAK BY 30% AT MALDON PREPARATORY SCHOOL, SILVER STREET, MALDON, ESSEX
Notification had been received from the Government Office for the East of England that the Secretary of State had refused consent to reduce the crown of one Holm Oak by 30% identified as T1 in the Order, situated at Maldon Court Preparatory School, Silver Street, Maldon.

Members recalled that the Town Council and Tree Warden had no objection to this application.

RECOMMENDED: that the information be noted.
 69. LICENSING
Notification had been received that David John Went, the Secretary of the Sportsman Billiards and Snooker Club had applied for the grant of a certificate of suitability for music and dancing in respect of the sportsman Billiards and Snooker club
