MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 16th SEPTEMBER, 2002 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

The Chairman welcomed Cllr S Savage and Cllr T Shrimpton to the meeting and said that although they were unable to vote they could take part in discussions.

Members will recall that at the Planning Committee meeting held on 19th February 2002 the Town Council had no objection in principle to this application. Members expressed their concerns regarding the additional traffic movement and felt that the roof covering may be inappropriate for the area.

Members expressed concern that construction vehicles would damage the new footpath in Beeleigh Road and suggested that they should enter and exit West Chase via London Road. It was felt that should the application be approved a letter be forwarded to Highways, Essex County Council requesting that construction traffic enter and exit West Chase via London Road.

RESOLVED: that the Town Council object to the amendment regarding this application due to the additional traffic movement. Members also felt the roof covering may be inappropriate for the area.

 11. TEL/MAL/02/00925 MALDON NORTH WEST
TEL/PN/02/0060 Telecommunications Application
Proposed erection of 15 metre high monopole, 3 antennae, 2 microwave dishes, equipment cabin and ancillary development.
Telecommunications Mast, West Station Yard, Maldon

A copy letter to Clive Tokely, Head of Planning Control, Maldon District Council from a member of the public was circulated to members at the meeting regarding the above application.

The Chairman adjourned the meeting at 7.55pm for a member of the public to read a copy letter expressing his concerns regarding the above application.

The Chairman reconvened the meeting at 8.05pm.

Lengthy discussion ensued and it was

RESOLVED: that the Town Council object to this application as the proposed development is contrary to Policy M/CC/3/5 Local Nature Reserves, Policy M/BE/24 Telecommunications Development and Policy M/BE/25 Requirement for Prior Approval. Members felt the telecommunications mast would have a detrimental impact to the residential area adjoining the site, the skyline and the surrounding countryside due to the height of the mast; a more rural location should be sought.

RESOLVED: that the Town Council object to this application as members felt the present dwelling is historically important to the area being one of the last examples of the town's rural heritage.

 84. LIST OF PLANNING DECISIONS - UP TO WEEK ENDING 30TH AUGUST 2002
Members received the list of Planning Decisions up to week ending 30th August 2002.

RECOMMENDED: that the information be noted.
 85. MEETING: 12TH SEPTEMBER 2002- PROPOSED AUDIT AND ASSESSMENT OF THE PLANNING SERVICE, TO ASSESS THE CURRENT LEVEL OF SERVICE AND TO INSTALL A PROGRAMME OF CONTINUED IMPROVEMENT
Further to minute 64 of the Planning Committee meeting held on 19th August 2002, members received a report (Appendix A) regarding the attendance of the Chairman and Planning Committee Clerk at the above meeting held on 12th September 2002 at the Maldon District Council offices.

The Chairman discussed the various points raised at the meeting in conjunction with the attached report.

Cllr Mrs. Downes felt that if an amended application is to be considered it would be beneficial to have a copy of the previous application at the meeting. Cllr Mrs. Downes also felt that the comments and views of the Heybridge Parish Council should be sought regarding applications received for The Causeway area of Maldon and it was

RECOMMENDED: that (a) the Planning Department, Maldon District Council be requested to forward a copy of previous planning applications when an amended application is to be considered;

(b) a letter be forwarded to Heybridge Parish Council stating that the Town Council would be pleased to receive their views regarding future planning applications in The Causeway area of Maldon.
 86. MALDON DISTRICT DRAFT REPLACEMENT LOCAL PLAN FIRST DEPOSIT
Members received a copy report of the Chief Planning and Development Services Officer, Maldon District Council, considered at the Planning and Licensing Committee meeting held on 12th September 2002.

Cllr Prior reported that most of the points referenced in the report related to the rural areas of the District with a few responses relating to Maldon town. He stated that the next stage for the Local Plan was the second deposit and requested that details regarding the time scales be sought from the Maldon District Council. Cllr Thain expressed the view that this was the Town Council's opportunity to make reference to the recommendations detailed in the report. It was suggested that a working party should be formed to consider the document and the Chairman requested nominations to sit on the working party. It was therefore

RECOMMENDED: that (a) Cllrs Mrs. S Reisebeck, S Savage, S Thain and W Prior serve on a Maldon Draft Replacement Plan Working Party;
(b) information regarding time scales for the second deposit be obtained from the Maldon District Council.

Subsequent to the meeting information was received that the next opportunity to comment on the Maldon District Draft Replacement Plan was January 2003 when the revised deposit period commences. Therefore after discussion with the Chairman it was felt that the working party meeting should be deferred until the amended document was available.

ESSEX COMMUNITY TRANSPORT PARTNERSHIP AGREEMENTS
Members received a copy report of the Chief Community Services Officer, Maldon District Council to the Community Services Committee meeting held on 9th September 2002.

RECOMMENDED: that the information be noted.
 88. PUBLIC SPEAKING AT THE DEVELOPMENT AND REGULATION COMMITTEE ON PLANNING APPLICATIONS - ESSEX COUNTY COUNCIL
Members received the following correspondence from the Essex Association of Local Councils regarding the above:

At the meeting in June 2002, the County Councils Development and Regulation Committee adopted a new scheme to the applicant, members of the public and the local district or parish council to address the Committee on planning applications. The new scheme will be effective as from the Committee's meeting on 27th September 2002.
At present the county are in the process of informing the public of the new process.

Please find enclosed a copy of the procedure for your records.

Discussion ensued after which Cllr Thain proposed and Cllr Mrs. Curtis seconded that a letter and a copy of the document be forwarded to Cllr Mrs. P Channer, Chairman, Maldon District Council commending the document and enquiring if the Maldon District Council would be considering the adoption of this procedure.

RECOMMENDED: that a letter be forwarded to Cllr Mrs. P Channer, Chairman, Maldon District Council, commending the document and enquiring when the Maldon District Council would be considering the adoption of this procedure and enclosing a copy of the above document.
 89. PLANNING APPLICATION FUL/MAL/02/00732 TOLLESBURY
Members noted that concern had been expressed by Cllr. Savage and a member of the public regarding the following planning application which was included on the 19th July 2002 weekly planning list:

FUL/MAL/02/00732 TOLLESBURY
Use of seabed for the temporary storage of 5 no. 400m long sections of 880mm diameter steel pipe
Midway between Thirslett Buoy & Baffle Wall River Blackwater, Tollesbury
Ballast Ham Dredging Ltd.
North West Area Committee
As a result of concerns expressed the Planning Officer, Maldon District Council had been contacted and stated that both Tollesbury and Bradwell-on-Sea Parish Councils had been consulted as well as all the statutory authorities regarding the river i.e. Trinity House etc. The Officer stated that it was not necessary for the Town Council to be approached regarding this particular application.

The Town Clerk has also contacted Tollesbury Parish Council who confirmed that they had no objection to the application. The pipes would be placed in an area that was very deep and not used for anchoring of boats; they would not be in situ for very long as they are going to be used in another location at the beginning of the new year; marker buoys would also be placed to indicate the location of the pipes.

The copy of the letter from the member of the public had been forwarded to the Planning Officer, Maldon District Council.

Cllr Savage expressed concern regarding the above application as he felt the pipes would be stored in the shipping lane and there would be a the risk to the oyster beds when the possible toxic water was released when the pipes are demobilised. He was also concerned that paperwork received at the Maldon District Council with the application was illegible. Discussion ensued and it was

RECOMMENDED: that a letter be forwarded to the Stewart Rowe, Development Control Officer, Maldon District Council expressing concern regarding the pipes being stored in the shipping lane, the risk from pollution to the oyster beds when the pipes were demobilised and that the paperwork received with the application was illegible.
 90. ROTARY FIREWORK DISPLAY - 2ND NOVEMBER 2002
Members received the following correspondence from the Rotary Club of Maldon:

I am writing to inform you that we have applied to Maldon District Council for the closure of the Bath Wall footpath at the Promenade Park, Maldon from 8.30 to 23.00 hours on Saturday 2nd November 2002, as this area will be used for setting up and firing the fireworks for the above display.

RECOMMENDED: that the information be noted.
 91. JUSTICES
Notification had been received that John Richard Tonks, Secretary of the Maldon Bowling Club has applied for a Registration Certificate for a period of five years in respect of the Clubhouse, Promenade Park, Maldon.

RECOMMENDED: that the information be noted.
