MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 7th OCTOBER, 2002 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Chairman: Cllr W Prior
Vice Chairman: Cllr Mrs. M Curtis
Councillors: E Bannister, A Josselyn, Mrs. S Riesebeck, K Smith and S Thain.
In Attendance: Cllr S Savage, the Town Clerk and the Planning Committee Clerk
The Chairman welcomed Cllr S Savage to the meeting and said that although he was unable to vote he could take part in discussions.
 92. APOLOGIES FOR ABSENCE

Apologies for absence were received from Cllrs Mrs. E Downes and Mrs. V Foster.
 93. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 16TH SEPTEMBER 2002

Cllr Savage made reference to the amendments made to the above minutes at the Council meeting held on 30th September 2002.

The minutes of the Planning Committee meeting held on 16th September 2002 were confirmed and signed as a true record.
 94. PLANNING APPLICATIONS

Members received and considered planning applications for weeks ended:

Full application
Amendment of condition 6 on planning permission FUL/MAL/99/00345 to allow opening Monday to Saturday 0830hrs to 2330hrs and Sunday 0830hrs to 2300hrs.

The Chairman declared a non pecuniary interest in the above application and took no part in the discussion.

Reference was made to a letter from the Maldon Society objecting to the above application.

Discussion ensued and it was

RESOLVED: that the Town Council object to this application, however members had no objection to the premises opening Monday - Saturday at 08.30am, closing in accordance with licensing hours and Sunday opening 10.30am and closing in accordance with licensing hours.

   Amendments - received from the Maldon District Council stating that the amendments raise no additional planning matters and would not require additional publicity.

The Planning Committee Clerk informed members that information had been received from the Maldon District Council that amendments to applications were forwarded to the Town Council for information and not for comment and she enquired if members wished such applications to be included on the weekly list and it was

RECOMMENDED: that amendments to applications continue to be included on the weekly planning list for information.

RESOLVED: that the Town Council has no objection to this application, members noted that the location plan showed the property on the wrong side of the road.

10. FUL/MAL/02/01019 MALDON SOUTH

RESOLVED: that the Town Council object to this application as members felt it would be detrimental to the general visual character of the premises due to the proposed flat roof.

11. TPO/MAL/02/01027 MALDON NORTH WEST

Works to Trees
Pruning works to two oak trees, removing low branches of both up to a height of 2.5m above ground level and reducing the crown of the largest oak tree by 50%.

RESOLVED: that the Town Council has no objection to this application subject to the approval of the Tree Warden; Tree warden report to follow.
 95. PLANNING DECISIONS

Members received a list of delegated planning decisions for week ending 13th September 2002.

RECOMMENDED: that the information be noted.
 96. FOOTPATHS

Further to minute 45 of the Planning Committee meeting held on 22nd July 2002, members received and considered a list of footpaths requiring attention (copy circulated to all members of the Council).

Discussion ensued and it was

RECOMMENDED: that the list of footpaths requiring attention be forwarded to Mr. S Broad, Transportation and Operational Services, Essex County Council with the addition of details of a hole in the path at Granger Avenue.

 97. PLANNING APPEALS, PERFORMANCE AND PROCEDURES

Members received a copy report from the Chief Planning and Development Services Officer, Maldon District Council to the Planning and Licensing Committee meeting held on 3rd October 2002.

Cllr Thain drew members attention to item 6.1 of the report regarding the Councils success record on planning appeals.

RECOMMENDED: that the information be noted.
 98. PLANNING APPLICATION FUL/MAL/02/00732 - TOLLESBURY

Use of seabed for the temporary storage of 5 no. 400m long sections of 880mm diameter steel pipe.
Midway between Thirslett Buoy & Baffle Wall River Blackwater, Tollesbury

North West Area Committee

Further to minute 89 of the Planning Committee meeting held on 16th September 2002, members noted that the above application had been withdrawn.

Cllr Savage informed members that he had received a letter regarding the above application and felt that it had possibly been withdrawn for various reasons including the fact that a number of people had not been consulted including the coastguard.

RECOMMENDED: that the information be noted.
 99. JUSTICES LICENSE

Notification had been received that (a) Nigel Ronald Miller of Cross Road, Maldon had applied for a Transfer of License in respect of the Yardarm, 185 High Street, Maldon for the sale of intoxicating liquor of all descriptions, to be held at the Court House, Witham on 11th November 2002;

(b) Stephanie Jane Valentine and Paul Alexander Jeffries both of Church Street, Maldon had applied for a Justices License in respect of the Sailing Barge "Hydrogen", The Hythe, Maldon for the sale of any intoxicating liquors for consumption either on or off the premises to be held at the Court House, Witham on 14th October 2002.

RECOMMENDED: that the information be noted.
