HELD ON MONDAY 28th OCTOBER, 2002 AT 7.30 P.M.

The Chairman welcomed Cllr S Savage and Cllr T Shrimpton to the meeting and said that although they were unable to vote they could take part in discussions.

 103. LIST OF PLANNING DECISIONS

Members received the list of delegated planning decisions up to week ending 18th October 2002 and committee planning decisions up to week ending 4th October 2002.

RECOMMENDED: that the information be noted.
 104. TRAFFIC MANAGEMENT

Further to minute 53 of the Planning Committee meeting held on 6 August 2002, members considered a 10 year plan to improve traffic management within the town and in conjunction with this a report was circulated listing the powers a Town Council has with regard to Highway matters.

Members were reminded that prior to last year's estimate meeting the Committee had investigated the cost of installing a pelican crossing and it was resolved at the Special Town Council meeting held on 3rd December 2001 that there be no financial provision within the estimates for a pelican crossing as it was felt it could set a precedent and was the responsibility of the Essex County Council.

Discussion ensued regarding this matter and it was felt that a working party should be formed to discuss past consultations and produce a list of requirements for consideration by the Council prior to submission to the Essex County Council.

Cllr Savage informed members that an area of paving slabs had been removed within the High Street and expressed concern that these had been replaced with tarmac. Reference was also made to the fact that the section of High Street, where the pedestrian crossing had been removed should be resurfaced. Discussion ensued and members agreed that these matters should be brought to the attention of Mr. S Broad, Transportation and Operational Services, Essex County Council to be rectified. Cllr Thain reiterated his previous comments that he felt the pedestrian crossing should not have been removed.

RECOMMENDED: that (a) a Working Party be set up from Council members to review all consultations over the past 2 years and compile a list of requirements for further consideration by the Town Council prior to submission to Mr. S Broad, Transportation and Operational Services, Essex County Council;

(b) a letter be forwarded to Mr. S Broad, Transportation and Operational Services, Essex County Council requesting that the road at the junction of Market Hill and the High Street where the pedestrian crossing was located, be resurfaced and the paving slabs be replaced in the High Street.
 105 MALDON DISTRICT DRAFT REPLACEMENT LOCAL PLAN FIRST DEPOSIT

Further to minute 86 of the Planning Committee meeting held on 16th September 2002, members received a copy of the Maldon District Council response to the Town Council submissions regarding the Maldon District Draft Replacement Local Plan First Deposit.

It was felt the Maldon District Council had noted the response of the Town Council when the representations were in support of the Draft Replacement Plan but were ignored when amendments or objections had been suggested.

RECOMMENDED: that a letter be forwarded to the Maldon District Council indicating that members felt the whole exercise was pointless as there had been no significant changes resulting from the responses of the Town Council.
 106. LBC/MAL/02/00842 MALDON NORTH WEST

Listed Building Consent
Remove ground and first floor partitions, remove and replace internal stairs, remove windows and doors from west elevation and replace with 4 new windows, remove and replace ground floor window in south elevation.

Further to minute 61.a.10 of the Planning Committee meeting held on 19th August 2002, members received and considered correspondence from W R Christopher Foyle regarding the above application and inviting members of the Planning Committee to meet him. Members were reminded that the Town Council objected to the application as it was felt it would affect the character of this historic building and in this respect reference was made to Policy No. M/BE/20 of the Maldon District Local Plan-First Review.

The Chairman informed members that the above application had been approved at the Maldon District Council Central Area Committee meeting. Members noted that an application had been received for substantial tree works (minute 102.d.20) and it would be beneficial for members to undertake a site visit during a weekend and it was

RECOMMENDED: that a letter be forwarded to Mr. Foyle accepting his offer of a visit to Beeliegh Abbey during a weekend.
FOR INFORMATION
 107. PEDESTRIAN CROSSING - HIGH STREET/MARKET HILL JUNCTION

Members received correspondence from (a) Mrs. Doreen Fawcett; (b) copy letter to Mr. B Mead from Mrs. B E Edwards regarding the pedestrian crossing High Street/Market Hill.

Discussion ensued and it was

RECOMMENDED: that Mrs Fawcett be informed that the Town Council had recommended that the pedestrian crossing be relocated further down the High Street, in the vicinity of the footpath leading from Friary Fields car park and not removed (minute 168 of the Planning Committee meeting held 4th March 2002 refers).
 108. POTENTIAL FOR DEVELOPMENT OF LAND SOUTH OF PROMENADE PARK

Further to minute 74 of the Planning Committee meeting held on 2nd September 2002, members received the following response from the Chief Executive, Maldon District Council:

Thank you for your letter of 3 October.

The proposals for the Promenade Park are at a very early stage of consideration and only the planning principles have been discussed as yet. There is no outstanding debt on the Council Offices specifically and there are no proposals to increase Council Tax as a result of any relocation.

More importantly, however, the proposed relocation would provide the opportunity for much needed affordable housing on the existing site of the Council Offices. It would also bring together the local authority, voluntary sectors and possibly other public bodies into one building and bring much needed leisure/tourist facilities to the District.

I hope that this answers the concerns raised by your members.

RECOMMENDED: that the information be noted.
 109. PUBLIC SPEAKING AT THE DEVELOPMENT AND REGULATION COMMITTEE ON PLANNING APPLICATIONS - ESSEX COUNTY COUNCIL

Further to minute 88 of the Planning Committee meeting held on 16th September 2002, members received the following correspondence from Councillor R L Bass C.C Leader of the Maldon District Council regarding the above:

Thank you for your letter of the 3rd October addressed to the Chairman, which has been passed to me for response.

Maldon District Council has no plans to introduce arrangements whereby members of the public can address meetings of its planning committees.

RECOMMENDED: that the information be noted.
 110. PLANNING APPLICATIONS - THE CAUSEWAY, MALDON

Further to minute 85.b of the Planning Committee meeting held on 16th September 2002, members received a response from the Clerk to Heybridge Parish Council regarding planning applications in The Causeway, Maldon.

RECOMMENDED: that the information be noted.
 111. JUSTICES LICENSES

Notification had been received that (a) Nigel Alfred Farmer of Beacon Hill, Maldon had applied for a new Justices License in respect of The Stable Brewery, Silver Street, Maldon to sell by retail at the premises beer, cider and wine for consumption off the Premises. The Owner of the premises in respect of which the application is made is Mr. John Wilsdon, Blue Boar Hotel, Maldon;

(b) Further to minute 99 of the Planning Committee meeting held on 7th October 2002, members noted that the Transfer of Justices License in respect of the Yard Arm, 185 High Street Maldon was to include the name of Louise Southern Miller;

(c) Andrea Jean Greig of North Street, Maldon and Joanne Greig of Hill Road Chelmsford were to apply for a transfer of the Justices Licence at the Court House, Newland Street, Witham on the 9th December 2002 for the sale of intoxicating liquor by retail for consumption on the premises in respect of The Galley (formerly April Thirteenth).

RECOMMENDED: that the information be noted.
