MINUTES OF THE TOWN COUNCIL MEETING
HELD ON MONDAY 16th DECEMBER, 2002 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

Prior to the commencement of the meeting the Mayor welcomed Reverend Macallister to the meeting who thanked members for inviting him to attend and then conducted prayers Rev. Macallister retired from the meeting.
 105. APOLOGIES FOR ABSENCE

Apologies for absence were received from Cllrs. Bentley, Mrs. Downes and Thain.
 106. MINUTES OF THE SPECIAL TOWN COUNCIL MEETING HELD ON 9TH DECEMBER, 2002

Members received and considered the minutes of the Special Town Council meeting held on 9th December, 2002.

RESOLVED: that the minutes of the Special Town Council meeting held on 9th December, 2002 be approved and signed as a true record.
 107. MAYOR'S ANNOUNCEMENTS

Members received and considered a list of functions attended by the Mayor and Deputy Mayor since the Town Council meeting held on 11th November, 2002.

The Mayor stated that once again the Victorian Evenings had been excellent and he had been glad to see several Councillors had also been in attendance. He also said that it had been a great pleasure to attend the Maldon District Handicapped Childrens' Association Christmas Party.

RESOLVED: that the information be noted.
 108.1 Planning Committee meeting held on 13th November, 2002.

Minute 114.a.4 - Planning Application No. FUL/MAL/02/01146

Cllr. Bannister expressed his concern that there had been no objection to this application as the plan had indicated that there would be no car parking spaces available and that access onto the High Street from the site was extremely narrow. He felt that the development would cause congestion in the High Street and that in the past planning applications had required properties to have 1.5 car parking spaces for each unit.

The Mayor informed Cllr. Bannister that this application would be returning to the Planning Committee for further consideration at the meeting to be held on 6th January, 2003.

Cllr. Kelly reminded members that Central Government were advocating the development of residential premises within High Streets including the area over shops and that car parking for these properties would be available in the High Street car parks.

RESOLVED: that the minutes of the Planning Committee meeting held on 13th November, 2002 be approved.
 108.2 Environment Committee meeting held on 18th November, 2002.

Minute 55.3 - Maldon Hall - Plots 39a and 39b
It was noted that the resolution should be amended from "10th February, 2002" to read "10th February, 2003".

RESOLVED: that (a) the resolution in minute 55.3 be amended to read "10th February, 2003";

(b) in all other respects the minutes of the Environment Committee meeting held on 18th November, 2002 be approved.
 108.3 Planning Committee meeting held on 25th November, 2002.

RESOLVED: that the minutes of the Planning Committee meeting held on 25th November, 2002 be approved.
 108.4 Finance and General Purposes Committee meeting held on 26th November, 2002.

Minute 64.5 - Guaranteed Investment Bond
In response to a question regarding the Guaranteed Investment Bond, the Town Clerk stated that the matter had been raised by the Internal Auditor. The view was expressed that further investigations should be undertaken to ascertain if better rates of interest were available from other financial institutions.

When put to the vote it was agreed that the matter be deferred until the Finance and General Purposes Committee meeting to be held on 13th January, 2003.

Minute 67 - Cinema
Cllr. Rew informed members that prior to the meeting there had been a demonstration of digital projection equipment by COMDIS who were currently offering a special offer price if the equipment was purchased by the end of December and should members agree to place an order this evening then the equipment could be in situ by the end of the week. The equipment would be supplied with a two year warranty for the projector and the appropriate leads would also be supplied. Members noted the cost of the equipment and that there would be an additional charge of £135 for a DVD player.

Cllr. Savage enquired if the suggested DVD player would provide "Surround Sound" as, although it was not currently required, it may be necessary in the future.

Members recalled that, when quotations had originally been sought for the projection equipment, the quotation from COMDIS had been the most competitive. Cllr. Rew reminded members that previously the Town Council's Cinema Club had been held between the months of October and May and he was of the opinion that the equipment should be purchased as soon as possible.

RESOLVED: that (a) the Town Clerk investigates other forms of investments;

(b) a NEC MT 105 XGA LCS Projector, NEC 4.25:1 Zoom lens and a DVD player which provides Surround Sound be purchased from COMDIS for the total sum of £4965 plus VAT
(Local Government Act 1972 s. 145);

(c) in all other respects the minutes of the Finance and General Purposes Committee meeting held on 26th November, 2002 be approved.

The Mayor and Chairman of the Finance and General Purposes Committee subsequently authorised the purchase of a Toshiba Multi Region DVD player for the sum of £185 which would provide "Surround Sound".
 108.5 Planning Committee meeting held on 10th December, 2002.

RESOLVED: that the notes of the Planning Committee meeting held on 10th December, 2002 be noted.
 109. MALDON YOUTH COUNCIL MEETING

Members received and considered the notes of the Maldon Youth Council meeting held on 19th November, 2002.

The Mayor referred to the fact that Gabby Sale had been elected as Chairman of the Youth Council for the coming year.

RESOLVED: that the notes of the Maldon Youth Council meeting held on 19th November, 2002 be noted.
 110. PLANNING MATTERS

Due to the fact that the Planning Committee meeting held on 10th December, 2002 was not quorate, members received and considered a report regarding the following planning matters including comments of the Maldon District Council (shown in italics) for each application.

(a) Proposed Disabled Parking Bays
Proposals for disabled parking bays at the following locations:

(i) High Street - south side - Leave as loading bay

(ii) High Street - southwest side - Support if moved from junction opposite Edward Bright Close to outside no. 8 King George Place opposite 133 High Street.

(iii) White Horse Lane - south side - Support

(iv) Wantz Road - west side - Requested that the Essex County Council defer this and look at it in conjunction with any other changes regarding parking that the Essex County Council may make.

(b) Proposed No Waiting and No Loading At Any Time Restrictions
Proposals for no waiting and no loading at any time restrictions at the following locations:

(i) Cherry Garden Road - both sides
Proposed no loading / unloading at any time - Support

(ii) Chequers Lane - northeast side
Proposed introduction of waiting restrictions
Mon - Sat 8.00 a.m. - 6.00 p.m. - Support - Essex County Council may be looking at no parking at any time in some locations

(iii) Fambridge Road - eastside Cross Road - both sides
Proposed introduction of no waiting at any time restriction Support

(iv) Highlands Drive - both sides (northwest - southwest length)
Proposed introduction at any time - Support

(v) Mount Pleasant - both sides
Proposed no loading / unloading at any time - Support

Concern was expressed that this proposal would be hazardous to the young families who resided in Mount Pleasant when loading and unloading children into vehicles. The Town Clerk stated that the location plans indicated that the restrictions were on the bends in the road and not outside residential properties.

(vi) Royal Court - both sides (southwest - northwest length)
No waiting at any time - Support

RESOLVED: that the Town Council submits to the Essex County Council the same comments regarding these planning matters as those already agreed by the Maldon District Council.
 111. BUS SHELTER

Further to minute 58 of the Environment Committee meeting held on 18th November, 2002 members received and considered a quotation from Bus Shelters Limited to supply and erect a bus shelter in the High Street.

Members recalled that the Essex County Council had indicated that £1000 would be forwarded towards a replacement shelter in addition to their maximum grant for bus shelters of £800.

RESOLVED: that the quotation in the sum of £2529 from Bus Shelters Limited for a CASTLE Aluminium Cantilever shelter be accepted.

 112. MALDON DISTRICT COUNCIL - BEST VALUE PERFORMANCE PLAN 2002

Further to minute 71 of the Town Council meeting held on 30th September, 2002 members received a response from the Environmental Policy Manager, Braintree District Council regarding recycling schemes in Braintree.

Discussion ensued during which members expressed the view that Braintree District Council operate a very good recycling system and it was felt that a copy of the letter should be forwarded to the Maldon District Council for information as they were keen to increase the percentage of recycling within the District.

RESOLVED: that a copy of the letter from Braintree District Council be forwarded to the Maldon District Council for information.
 113. PARISH TRANSPORT GRANTS

Further to minute 68.2 of the Town Council meeting held on 30th September, 2002 members received a response from the Rural Transport Manager, Essex County Council which stated there were technical difficulties in unlocking Parish Transport Grants' funding for Town Councils.

The Town Clerk informed members that a letter had been received from the Plume School regarding the possibility of a Parish Transport Grant being utilised to provide transport for pupils who take part in after school activities and it was noted that this matter would be discussed at the Finance and General Purposes Committee meeting to be held on 13th January, 2003.

RESOLVED: that the response be noted.
 114. MAY ELECTIONS

Members were requested to consider a strategy to encourage people to come forward and stand for the Town Council election to be held in May, 2003. The Town Clerk informed members that the Heybridge Parish Council had included an article in the Heybridge Herald to promote that Council.

Discussion ensued and members felt that it would be helpful if persons from the business sector were attracted to stand for election to enable the Town Council to utilise their expertise.

In response to a question regarding Press Releases the Town Clerk advised that releases were issued after Town Council meetings and the press regularly telephoned the office for information.

RESOLVED: that reference to the forthcoming election be included in a future Press Release.
 115. MID ESSEX AREA FORUM

Further to minute 116(b) of the Planning Committee held on 13th November, 2002 members received:

A verbal report from Cllr. Prior regarding the Mid Essex Area Forum held on 14th November, 2002.

Cllr. Prior informed members that the following three principal issues had been discussed at the Forum with a view to taking Essex County Council business to the general public:

* Improving the relationships between the County Council , District Councils and Town and Parish Councils;
* Waste Management;
* Stansted Airport - this would be a major topic of discussion over the next few months.

Members then considered whether Parish Cllrs. Tilly Pink or Ken Ascott, the Maldon representatives on this Forum, should be invited to attend a future meeting of the Town Council.

Discussion ensued and it was felt that it would be helpful if Cllr. Ken Ascott was invited to attend a future meeting.

RESOLVED: that (a) the report of Cllr. Prior be noted;

(b) Cllr. K. Ascott be invited to attend a future meeting of the Town Council.
 116. SHAKESPEARE FESTIVAL - MAY / JULY 2003

Members received and considered a request from the Arts Officer, Maldon District Council regarding a Shakespeare Festival to be held in Maldon during the period May to July, 2003. The event was being organised by the Town Centre Manager in conjunction with the Maldon District Council and would include a community play - A Midsummer Nights' Dream - which would be performed in the Promenade Park. The Arts Officer enquired if the Town Council would consider providing a weekly rehearsal venue for the play in the Town Hall from early January until the end of May.

Discussion ensued and members agreed that Maldon should celebrate the 400th anniversary of Shakespeare's visit to Maldon. Members also agreed in principle to provide a venue for rehearsals.

The view was expressed that it would be beneficial for the Town Centre Manager together with the District Council Arts Officer to attend a future Town Council meeting to present a package regarding the Shakespeare Festival.

RESOLVED: that (a) subject to availability either the Town Hall or the Conference Room be offered on Wednesday evenings as a rehearsal venue for the community play, A Midsummers Nights' Dream;

(b) the Town Centre Manager and District Council Arts Officer be invited to attend a Town Council meeting to present a package regarding the Shakespeare Festival.
 117. DECRIMINALISATION OF PARKING ENFORCEMENT

Members received and considered a letter from the Community Services Manager, Maldon District Council indicating that with effect from 1st April, 2003 the Maldon District Council would be taking responsibility for enforcing all car parking enforcement within the District.

Concern was expressed that, as there is no longer a Traffic Warden in Maldon, there might be an increase in illegal parking throughout the town. It was agreed that the Maldon Police should be asked how parking matters were to be dealt with between now and April 2003 when parking enforcement became the responsibility of the District Council.

RESOLVED: that (a) a letter be forwarded to the Maldon Police to enquire how parking matters were to be dealt with between now and April, 2003 when the Maldon District Council becomes responsible for parking enforcement;

(b) the information from the Maldon District Council be noted.
 118. MALDON PARISHES GROUP MEETING

Further to minute 100 of the Town Council meeting held on 11th November, 2002 members were informed that notification had been received from the Corporate Services Officer, Maldon District Council regarding the next meeting of the Maldon Parishes Group which was to be held at the Langford and Ulting Village Hall on Thursday, 3rd April, 2003 commencing at 7.30 p.m. Members were advised to notify Eva McNeill no later than Monday 3rd March, 2003 if they wished to raise a matter at the meeting.

RESOLVED: that the information be noted.
 119. ASSOCIATION OF ESSEX AUTHORITIES AND COUNTY STRATEGIC PARTNERSHIP - DRAFT COMMENTS ON SERAS REPORT

Members received draft comments regarding the SERAS report from the Association of Essex Authorities and County Strategic Partnership.

RESOLVED: that the SERAS report be noted.
 120. REGIONAL GOVERNMENT: CAUTIOUS WELCOME OR EMPHATIC REJECTION

At the request of Cllr. Prior members received the document Regional Government: Cautious Welcome or Emphatic Rejection.

 121.2 Town Centre Manager's Activities - October and November, 2002

Members received and considered reports regarding the Town Centre Manager's activities for the months of October and November, 2002.

 122. EUROPEAN NORTH SEA FLOOD CONFERENCE - "THE 1953 FLOODS AND BEYOND"

Notification had been received from the Corporate Services Officer, Maldon District Council regarding a European North Sea Flood Conference being held on Thursday, 30th January, 2003 at the John Innes Centre, Norwich. The Conference had been organised by the County Council's of Lincolnshire, Norfolk, Suffolk and Essex to commemorate the 50th Anniversary of the tragic events of the 1953 floods. The cost for attending the conference is £90 per delegate.

RESOLVED: that the information be noted.

EALC - Nuts and Bolts Course - 15th November, 2002 - Cllr. Prior and the Town Clerk

Cllr. Prior reported that the course had been interesting and enlightening and referred in particular to the following:

* Size of Councils: Maldon Town was in the top 25%
* Essex Act 1987 - Special Powers
* L.G.A. 1972 - Section 137 - The Town and Parish Council Credit Card

RESOLVED: that the report be noted.
 123.2 Maldon District Community Safety Partnership - 21st November, 2002 - Cllr. Mrs. Riesebeck

Cllr. Mrs Riesebeck verbally reported that the meeting had considered how to keep oneself and members of the community safe. Items discussed included CCTV cameras within the town and additional street lights in alleyways.

RESOLVED: that the report be noted.
 123.3 Youth in the Community - 23rd November, 2002 - Cllr. Mrs Riesebeck

Cllr. Mrs. Riesebeck reported that one of the main areas of discussion had been the various sources of funding which were available for youth groups. It was noted that the Maldon Youth Council could apply for funding to hold a Baseline on Ice event from "CrimeBeat" which is managed by the Essex Community Foundation.

RESOLVED: that the report be noted.
 123.4 Maldon Chamber of Trade and Commerce Committee Meeting - 2nd December, 2002 - Cllr. Prior

Cllr. Prior reported that only a few members had attended the meeting and topics of discussion included the quorum at meetings, increasing membership, funding, quality of roadworks and car parking.

RESOLVED: that the report be noted.
