MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 19th JANUARY, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

In Attendance: District Cllr Mrs. B Keighley, District and Town Councillor W Prior, Cllr D Keighley, the Town Clerk and the Planning Committee Clerk.
   The Chairman welcomed Cllr Prior to the meeting and said that although he was unable to vote he could take part in discussions.

The minutes of the Planning Committee meeting held on 5th January were confirmed and signed as a true record.

The Notes of the meeting held on 5th January 2004 with Representatives of Quest Motors were circulated with the weekly list of planning applications.

Cllr Prior enquired if he should declare an interest in the above application and was informed that it was not necessary as he was not a member of the Planning Committee.

Discussion ensued and it was felt that the Town Council's policy to protect open spaces should be adhered to and reference was made again to the Essex County Council Highway markers on the site.

RESOLVED: that the Town Council object to this application as it is Town Council policy to protect open spaces. The Town Council is also concerned about the Essex County Council Highway markers on the area of land.

6. FUL/MAL/04/00014 MALDON WEST

 177. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 178. MALDON DISTRICT REPLACEMENT LOCAL PLAN PUBLIC LOCAL INQUIRY

Further to minute 167 of the Planning Committee meeting held on 5th January 2004, members received the Maldon District Council response to an objection to the Draft Replacement Local Plan - Inquiry Document Reference: MDC/POL/REC12A Leisure and Civic Quarter.

Cllr Prior although not a member of the Planning Committee declared a personal and prejudicial interest in the above agenda item and left the room.

RECOMMENDED: that the information be noted.
 179. WARWICK DRIVE/WARWICK CRESCENT, MALDON
PROPOSED LIMITED WAITING RESTRICTION

Further to minute 169 of the Planning Committee meeting held on the 5th January 2004, members received and considered correspondence from Highways, Essex County Council regarding proposed waiting restrictions at Warwick Drive/Crescent.

Discussion ensued during which members agreed with the proposals in respect of Warwick Crescent East and West, however, concern was expressed regarding the proposed restriction at the King Street end. It was felt that some parking spaces need to be left to enable parents dropping off and picking up children from school to park and also people visiting the doctors when the surgery car park is full.

RECOMMENDED: that a letter be forwarded to Essex County Council, Highways stating that the Town Council object to the proposed waiting restrictions at the King Street end of Warwick Drive and have no objection to the proposals regarding Warwick Crescent East and West.
 180. PLANNING APPLICATION OUT/MAL/03/01209 CON/MAL/03/01213
NEW TREES WELLINGTON ROAD, MALDON

Further to minute 153.6 of the Planning Committee meeting held on 9th December 2003, members received a letter from Mr. and Mrs. Want regarding the above application and the lack of time available for the public to submit letters to the Town Council to be considered at Planning Committee meetings. Members recalled that the Town Council Planning Committee had no objection to this application.

Members felt that the planning system relies on the public coming forward with their views and in this respect they can attend Town Council Planning meetings; it was also felt that feedback from the public is advantageous. It was noted that applications can be received at the Town Council Office on the day of the meeting but this had not been the case with the above application. The Chairman said he would speak to the editor of the Maldon and Burnham Standard requesting that the public be informed that their comments regarding planning applications should be sent to the Town/Parish Councils as well as the District Council.

RECOMMENDED: that the Chairman contact the editor of the Maldon and Burnham Standard requesting that the public be informed that any comments regarding planning applications should be sent to the Town/Parish Councils as well as the District Council.
 181. CAMPAIGN TO PROTECT RURAL ENGLAND

Members received and considered a letter from Sir Nigel Thompson, Campaign to Protect Rural England regarding Government proposals to reshape the Planning System.

RECOMMENDED: that a letter be forwarded to the Minister for Housing and Planning, Office of the Deputy Prime Minister urging him to support the amendments to the Planning and Compulsory Purchase bill to (a) give County Councils a statutory responsibility to engage in the preparation and review of the new Regional Spatial Strategies;

(b) to address the urgent need for better enforcement of planning controls.

 182. RIVER BLACKWATER - FULLBRIDGE TO BEELEIGH

Further to minute 142.b of the Planning Committee meeting held on 12th December 2003, members received a letter from the Project Officer, the Blackwater Project regarding the stretch of the River Blackwater from Fullbridge to Beeleigh.

Cllr Mackenzie expressed concern that this stretch of the River Blackwater does not come under the responsibility of any organisation and informed members that since improvements had been undertaken to the river bank in the vicinity of the Royal Mail Sorting Office further erosion had been caused to the opposite river bank.

RECOMMENDED: that the information be noted and the enquiry continues as to who is responsible for this stretch of the river.
 183. MARKET HILL, WHITE HORSE LANE, CHEQUERS LANE AND HIGH STREET, MALDON
PROPOSED DISABLED PARKING BAYS AND NO WAITING AT ANY TIME RESTRICTION

Further to minute 160 of the Planning Committee meeting held on 9th December 2004, members received a response from the Area Manager South, Highways, Essex County Council making further comments regarding their proposals.

Members were informed that the proposed disabled parking bays at Market Hill, Chequers Lane and Embassy Court were considered at a recent Maldon District Council, Central Area Committee meeting at which Mr. S Broad, Highways Department was in attendance.

The Chairman adjourned the meeting for District Cllr Mrs. B Keighley to speak.

Cllr Mrs. B Keighley reported that the District Council, Central Area Committee had fully supported the Town Councils comments but the matter also had to be considered by the Planning and Licensing Committee.

It was felt that Maldon had sufficient disabled parking bays and that the Essex County Council were only looking at the highway and were not taking into consideration disabled parking bays within the car parks. It was noted that no statistical surveys had been undertaken relating to disabled parking bays.

The Chairman re-convened the meeting.

It was noted from the letter received from the Essex County Council that the Local Member had supported the proposals. Members of the Planning Committee enquired if this referred to the Essex County Councillor for Maldon and the view was expressed that if this was the case he must be expressing a personal view as the Town Council had never been consulted.

Discussion ensued and it was

RECOMMENDED: that a further letter be forwarded to Highways, Essex County Council objecting to the proposals to install disabled parking bays at the lay-by at the top of Market Hill, Chequers Lane and by Embassy Court and enquiring if a survey had been undertaken to establish the need for more disabled parking bays within Maldon.
 184. JUSTICES LICENCE

Notification had been received that (a) Robert James MacDonald of Sycamore Way, Clacton-on Sea and Karen Seeley of Icelands Foods Plc, High Street, Maldon were to apply for a transfer of Justices Licence for the sale of intoxicating liquor of all descriptions by retail, for consumption off the premises in respect of 'Iceland' 62-66 High Street, Maldon;

(b) Kudlip Sehmi of Newbury Park, Ilford and Teoddy Terrado of Walthamstow, London were to apply for a Provisional Justices' On-Licence to sell by retail intoxicating liqueur of all descriptions for consumption on the premises in respect of 'Prezzo' 69-71 High Street, Maldon

RECOMMENDED: that the information be noted.
