MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 2nd FEBRUARY, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

In Attendance: The Town Clerk, the Planning Committee Clerk and one member of the public.
   One minutes silence was held in memory of the past Mayor and Councillor Keith Munnion who had sadly passed away.

Cllr Mrs. S Riesebeck declared personal and prejudicial interest in the above application and left the room, Cllrs K Smith and S Savage declared a personal interest and Cllr Smith left the room.

RESOLVED: that the Town Council object to this application and reference was made to the Appeal in respect of 63 Church Street, Maldon - Appeal Reference APP/A/03/1121543 in which the only permitted development allowed was the erection of a summerhouse. Members felt the same criteria should apply with regard to this application

 188. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS Members received the list of Maldon District Council Planning Decisions. RECOMMENDED: that the information be noted.
 189. ROAD SAFETY WORKING PARTY

Further to minute 127 of the Planning Committee meeting held on 10th November 2003, members received the notes of the Road Safety Working Party meeting held on 19th January 2004.

Cllr Shrimpton enquired if any consideration had been given to trying to persuade retail premises with rear access to use these accesses for delivery rather than the High Street; he was informed that this could be considered at the next meeting. It was suggested that any road safety matters be submitted to the Town Clerk prior to the next Road Safety Working Party meeting to be held at 6.30pm on 16th February 2004.

RECOMMENDED: that the information be noted.
 190. MALDON DISTRICT REPLACEMENT LOCAL PLAN PUBLIC LOCAL INQUIRY

Further to minute 178 of the Planning Committee meeting held on 19th January 2004, members received the Maldon District Council response to an objection to the Draft Replacement Local Plan - Inquiry Document Reference: MDC/POL/CON1 Development in Areas at Risk from Flooding.

RECOMMENDED: that the information be noted.
 191. ESSEX MINERALS LOCAL PLAN SECOND REVIEW - FIRST DEPOSIT DRAFT

Further to minute 200 of the Planning Committee meeting held on 3rd March 2003, members noted that the Second Review was now on public deposit and a copy was available in the office.

The Chairman asked that the above item be deferred to the next meeting to enable him to review the document.

RECOMMENDED: that the Essex Minerals Local Plan Second Review - First Deposit Draft be deferred to the next Committee meeting.
 192. TOWN AND COUNTRY PLANNING ACT 1990

THE TOWN AND COUNTRY PLANNING (TREES) REGULATIONS 1999
TREE PRESERVATION ORDER (TPO) NO. 1/04
LAND ADJACENT 6 WORDSWORTH AVENUE, MALDON

Further to minute 146 of the Planning Committee meeting held on 24th November 2004, notification had been received that the above mentioned TPO which was made by the District Council on 8th January 2004 became provisionally effective on that date and would remain so until confirmed or otherwise within the period of six months from the date.

RECOMMENDED: that the information be noted.
 193. PUBLIC ENTERTAINMENT LICENCE - SPORTSMAN SNOOKER CLUB

Further to minute 171 of the Planning Committee meeting held on 5 January, 2004, members noted that a letter had been received from the Licensing Officer, Maldon District Council advising that the Hearing had been set for 7.00 p.m. on 16 February at the Council Offices. Cllr. Mackenzie would be able to speak in support of the Town Councils objection at the hearing and they were enquiring as to whether he would be accompanied by a legal representative.

Cllr Mackenzie informed members that he would be able to attend the Hearing and would be representing the residents of Market Hill. In view of this he enquired as to whether he should continue to represent the Town Council.

Discussion ensued regarding this matter and whether the Town Council should have legal representation. In this respect it was suggested that enquiries be made of the Maldon District Council to ascertain if they will be objecting to the Music and Dancing Licence and would be represented by their Solicitor. Enquiries should also be made with the Town Councils Solicitor regarding representation and the matter be submitted to the Town Council meeting to be held on 9th February 2004.

RECOMMENDED: that (a) the Town Clerk enquire if the Maldon District Council are to object to the granting of the Music and Dancing Licence in respect of the Sportsman Snooker Club and whether they would be represented by their Solicitor;

(b) enquires be made of the Town Council's Solicitor regarding representation and the matter be further considered at the Town Council meeting to be held on 9th February 2004.
 194. TOWN AND COUNTRY PLANNING ACT 1990

APPEALS BY BOVIS HOMES LTD
LAND AT ELMS FARM, LAND SOUTH OF HOLLOWAY ROAD, HEYBRIDGE, MALDON

Notification had been received that a date for the inquiry into the above appeal had been arranged to take place at the District Council Offices at 10.00am on Tuesday 30th March 2004.

RECOMMENDED: that the information be noted.
 195. TRANSFER OF JUSTICES LICENCE

Notification had been received that Ronald Edward and Eileen Joan Slight of Great Justices, Wethersfield Road, Finchingfield, Essex and Tina Ann Slight of the Borough Arms PH, Wantz Road, Maldon were to apply for a transfer of Justices Licence for the sale of intoxicating liquor of all descriptions by retail, for consumption on or off the premises in respect of the Borough Arms Public House, Wantz Road, Maldon.

RECOMMENDED: that the information be noted.
