MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 16th FEBRUARY, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

In Attendance: Town and District Cllr W Prior, the Town Clerk and the Planning Committee Clerk.
   The Chairman welcomed Cllr Prior to the meeting and said that although he was unable to vote he could take part in discussions.
 196. APOLOGY FOR ABSENCE

An apology for absence was received from Cllr I Mackenzie.
 197. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 2ND FEBRUARY, 2004

The minutes of the Planning Committee meeting held on 2nd February 2004 were confirmed and signed as a true record.
 198. PLANNING APPLICATIONS

The Chairman informed members that a new planning procedure was to be implemented following a recent complaint regarding the lack of time available for the public to submit comments to the Town Council on planning applications. Cllr Shrimpton said that as the Town Council were consultees there was no responsibility to consult with the public; the Chairman felt that the Town Council should be in a position to receive and consider comments the public may want to submit. In this respect all planning applications received in the office on the Monday of the week in which a Planning Committee meeting was being held would in future be considered at the next Planning Committee meeting; any applications that would not be accommodated within this time scale,and if an extension of time was not granted by the Maldon District Council, would be dealt with as an emergency as detailed in standing orders.

   1. FUL/MAL/04/00116 MALDON NORTH

Full Application
Six one-bed flats and one-bed maisonette in part 2 storey, part 2 and half storey block, associated landscaping and external works.

A supporting statement in respect of the above application was circulated.

Reference was made to 'Maldon's Future: A Community View', the Town Design Statement for Maldon which states that 'there should be parking provision'.

RESOLVED: that the Town Council objects to this application for the following reasons: over development of the site; lack of car parking spaces provided and not in keeping with surrounding properties.

2. CON/MAL/04/00118 MALDON NORTH

Conservation Area Consent
Demolition of existing storage outbuildings to clear site (as necessary supplement to detailed application for 7 one-bedroom flats (Butt Mill) on cleared site).

A letter of objection regarding the above application was circulated.

RESOLVED: that the Town Council object to this application due to over development of the site and the loss of light would be detrimental to the neighbouring property.

RESOLVED: that the Town Council noted the amendment to this application.

RESOLVED: that the Town Council noted the amendment to this application.

8. FUL/MAL/04/00029 MALDON NORTH

Full Application
Erection of single storey rear extension and provision of dormer to rear.

The application was amended by the revision of the description of the proposal to:

Pitched roof rear extension, loft conversion, realignment of roof pitch and rear facing dormer.

RESOLVED: that the Town Council noted the amendment to this application.
b. Applications received Week Ending 13th February 2004
   Circulated at the meeting was a copy of the list of Planning applications received for the week ending 13th February 2004.

The Chairman reiterated what he had said previously that these applications would be considered at the next Planning Committee meeting. This would enable members of the public to forward their comments and councillors time to look at the application sites.
 199. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 200. MALDON DISTRICT REPLACEMENT LOCAL PLAN

PUBLIC LOCAL INQUIRY

Further to minute 190 of the Planning Committee meeting held on 2nd February 2004, members received:

(a) from the Programme Officer, Inquiry Office, Maldon District Council information that the Local Plan Inquiry will officially close on Friday 19th March 2004 at 2.30pm in the Council Chamber, Maldon District Council and no further representations or comments can be received after that date;

(b) the Maldon District Council responses to the following Town Council objections to the Draft Replacement Local Plan:

Policy MDC/POL/H1 - Location of New Housing
Policy M/CC/1 - Protection of International and National Designated Nature Conservation Sites.
Policy M/CC/11 - Maldon Waterside Area
Policy M/E/2 - Sadd's Wharf Employment Allocation
Policy M/CON/5 - Contaminated Land
Policy M/E/4 - Protection of Existing Employment Uses
Policy M/CON/4 - Development on Unstable Land

RECOMMENDED: that the information be noted.
 201. ESSEX MINERALS LOCAL PLAN SECOND REVIEW - FIRST DEPOSIT DRAFT

Further to minute 191 of the Planning Committee meeting held on 2nd February 2004, members noted that the Second Review was now on public deposit and a copy was available in the office.

The Chairman informed members that he had read the above document and in answer to a question replied that there were no mineral extractions within the town boundary. Members were also informed that the new Planning and Compulsory Purchase Bill would be looking at the Mineral and Waste Development Framework which would also control the transport distribution of minerals. It was noted that water was classified as a mineral and although not directly concerned with the town, water is extracted for bottling at a site in Wickham Bishops where large lorries transport bottles on the country roads.

RECOMMENDED: that the information be noted.
 202. WARWICK DRIVE/WARWICK CRESCENT, MALDON

PROPOSED WAITING RESTRICTIONS

Further to minute 179 of the Planning Committee meeting held on 19th January 2004, members received and considered a response from Mr. A Dellar, Highways Department, Essex County Council regarding the above proposals. Mr. Dellar requested that the Town Council reconsider their decision regarding the proposed waiting restriction in Warwick Drive/Warwick Crescent as the proposal was designed to deal with a potential road safety issue where on street parking was regularly obscuring driver sightlines and obstructing forward visibility.

Discussion ensued and it was

RECOMMENDED: that (a) the Highways Department, Essex County Council be informed that the Town Council had reconsidered the proposed waiting restriction in Warwick Drive/Warwick Crescent and in light of additional information received had no objection;

(b) that minute 179 of the Planning Committee meeting held on 19th January 2004 be rescinded.
 203. BEST PRACTICE GUIDE TO WALKING

Members noted that the above document had been received from the Essex County Council Highways Group. This was an update of the Pedestrian and Mobility Policy taking into consideration requirements of the Disability Discrimination Act 1995 which comes into force October 2004.

The Chairman suggested that members of the Road Safety Working Party would find it beneficial to read the Guide.

RECOMMENDED: that the information be noted.
 204. TEMPORARY SIGNALS WANTZ ROAD/MUNDON ROAD/CROSS ROAD/MILL ROAD MALDON

Members received from the Highways Department, Essex County Council information that temporary signals were to be installed at Wantz Road/Mundon Road/Cross Road/Mill Road Maldon; work was scheduled to commence on 10th February 2004.

Cllr Riesebeck informed members that several residents had commented on how quiet the road had been while the traffic lights were in operation.

RECOMMENDED: that the information be noted.
 205. TEMPORARY ROAD CLOSURE

NORTHBOUND CARRIAGEWAY ONLY - MUNDON ROAD, MUNDON

Members were informed that notification had been received from the Highways Department, Essex County Council that there was to be a temporary road closure of the northbound carriageway only of Mundon Road, Maldon for 2 days commencing on 15th March 2004. This closure was required to enable carriageway work to be undertaken in the interests of road safety for both members of the public and the workforce.

RECOMMENDED: that the information be noted.
 206. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY THOMAS BATES & SON LIMITED AND BARRATT EASTERN COUNTIES
SITE AT LAND AT HALL ROAD, HEYBRIDGE, MALDON
APPLICATION NUMBER: FUL/MAL/01/00716

Members received the Appeal Decision regarding the appeal by Thomas Bates & Son Ltd and Barratt Eastern Counties in respect of the site at land at Hall Road Heybridge, Maldon from which it was noted that the appeal had been dimsissed. Members recalled that the Town Council objected to this application.

RECOMMENDED: that the information be noted.
 207. TOWN AND COUNTRY PLANNING ACT 1990

PLANNING (LISTED BUILDING AND CONSERVATION AREAS) ACT 1990
APPEALS BY BROOKGLADE SPECIAL PROJECTS LTD
SITE AT THE OLD FIRE STATION, 20-22 LONDON ROAD, MALDON
APPLICATION NUMBERS: FUL/MAL/03/00666 CON/MAL/03100667

Members received the Appeal Decision regarding the appeal by Brookglade Special Projects Ltd in respect of the site at the old Fire Station, 20-22 London Road, Maldon from which it was noted that the appeal had been allowed and planning permission granted. Members recalled that the Town Council had no objection to this application subject to a condition being imposed stating that the garages were not to be used for habitation (minute 85.a.4 refers).

RECOMMENDED: that the information be noted.
 208. PLANNING AND COMPULSORY PURCHASE BILL

Further to minute 181 of the Planning Committee meeting held on 19th January 2004, members received correspondence from the Rt Hon Keith Hill MP, Office of the Deputy Prime Minister regarding the Planning and Compulsory Purchase Bill.

The press release referred to in the correspondence was circulated to members.
