MINUTES OF THE SPECIAL PLANNING COMMITTEE MEETING HELD ON TUESDAY 8th MARCH, 2004 AT 7.30 P.M. IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Chairman: Cllr S Savage
Vice Chairman: Cllr. S. Swallow
Councillors: Mrs. M. Curtis, I Mackenzie, T Matthams,
Mrs. S. Riesebeck and T. Shrimpton.
In Attendance: The Town Clerk, District and Town Councillor W. Prior and l member of the press.
The Chairman informed Cllr. Prior that he was welcome to take part in the discussions but he could not vote.
 221. APOLOGIES FOR ABSENCE

There were no apologies for absence.
 222. MALDON DISTRICT DRAFT REPLACEMENT LOCAL PLAN REVISED DEPOSIT

Further to the Planning Committee meeting held on 1st March, 2004 the Chairman reminded members that responses to the Draft Replacement Local Plan had to be submitted by 12 March, 2004 and in view of this it had been necessary to hold a Special meeting.

Members received and considered the Maldon District Council responses to the following Town Council objections to the Draft Replacement Local Plan:

(a) Reference - MDC/POL/PU4 - Civic and Community Uses

Members were reminded that they had requested that the word "civic" be deleted from the policy and text in the Revised Deposit version of the Plan.

The District Council had responded that the policy and associated text as drafted in the Revised Deposit Draft adequately reflected the planning issues concerning Community Uses and required no further change.

Discussion ensued regarding this matter and it was:

Resolved: that the Maldon District Council be informed that the Town Council wishes the word "civic" to be deleted from the policy.

(b) Reference - MDC/POL/PU - Miscellaneous Issues

Members were reminded that they had requested that further text be added to paragraph 10.33 to state that the District Council will take an interest in sewage disposal in the adjacent areas that flow into the river.

Lengthy discussion ensued regarding this matter during which it was explained that raw sewage was seen in the river at times of extreme storm waters and it was felt that the response from the Maldon District Council was not addressing the situation.

In answer to a question it was suggested that anyone seeing raw sewage in the river should contact the Environment Agency.

Resolved: that a further letter be forwarded to the Maldon District Council stating that their response had not addressed the Town Council's concerns.

(c) Reference - MDC/POL/REC12a - Leisure and Civic Quarter, South East Maldon

Members were reminded that the Town Council had requested the deletion of Paragraph 8.53b apart from its first sentence and all of paragraph 8.53c so that references to the Leisure and Civic Quarter proposals were removed. The response received from the Maldon District Council stated that no further changes to the Plan were recommended in respect of the objection.

The view was expressed that the Maldon District Council were forcing this issue through without listening to the people of Maldon and the Town Council and in this respect it was

Resolved: that the District Council be informed that the Town Council's original objection stands and Paragraph 8.53b apart from its first sentence and all of paragraph 8.53c should be deleted so that references to the Leisure and Civic Quarter proposals are removed.

(d) Reference - MDC/POL/H4/SITE 5 - Housing Site 5, Princes Road, Maldon

Members were reminded that the Town Council had requested that the reference to the allocation of a further site for housing at Princes Road should be deleted from paragraph 4.20 and from Table 3. The response from the Maldon District Council had stated that no changes were recommended to this Policy or its background text.

Reference was made again to the fact that the proposals seem to be being pushed through despite objections from the public.

Concern was expressed regarding the lack of car parking at the Doctors surgeries and the fact that housing development could restrict this further.

The Chairman made reference to the fact that the residents of Wantz Road have been told that they can use the District Council car park on Saturdays, Sundays and Bank Holiday Mondays and enquired where these vehicles would park if the development were to proceed.

Reference was also made to 5.15 of the document which indicated that the District Council had allocated land for extra car parking at three extensions to two car parks in the town centre; these proposals would contribute to a 20% increase in car parking facilities in the town centre. The question was asked as to where these areas would be.

Resolved: that a further letter be forwarded to the Maldon District Council (i) stating that the Town Council is of the opinion that the reference to the allocation of a further site for housing at Princes Road should be deleted from paragraph 4.20 and from Table 3l;

(ii) enquiring where the residents of Wantz Road will park on Saturdays, Sundays and Bank Holiday Mondays;

(iii) expressing concern regarding parking for the Doctors surgeries;

(iv) enquiring as to the location of the three extensions to two car parks in the town centre.

(d) Reference - MDC/POL/PU1 - Protection of Health Care Facilities

Members were informed that the Town Council had requested that the wording in paragraph 10.21 in the Revised Deposit Draft "and will expand wherever possible" be reinstated in relation to outpatient facilities at St. Peters Hospital in Maldon and local clinics, as in the First Deposit version of the Plan.

The response from the Maldon District Council stated that no further changes to the Plan were recommended.

Discussion ensued during which reference was made to the fact that the above wording should be reinstated until an alternative hospital site is located in the Maldon area, whereupon the matter should be reviewed.

Resolved: that a further letter be sent to the Maldon District Council stating that the words "and will expand wherever possible" be reinstated in relation to outpatient facilities at St. Peters Hospital in Maldon and local clinics, as in the First Deposit version of the Plan, until an alternative hospital site is located in the Maldon area, whereupon the matter should be reviewed.
