MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 15th MARCH, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Chairman: Cllr S Savage
Vice Chairman: Cllr J Swallow
Councillors: Mrs M Curtis, K Jennings, I Mackenzie
T Matthams, Mrs S Riesebeck, T Shrimpton and
K Smith (Town Mayor).
In Attendance: Cllr D Keighley, District Councillor Mrs B Keighley, the Town Clerk and the Planning Committee Clerk.
   The Chairman welcomed District Cllr Mrs Keighley and Cllr D Keighley to the meeting and said that Cllr Keighley could take part in the meeting but could not vote.
 223. APOLOGIES FOR ABSENCE

There were no apologies for absence.
 224. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 1ST MARCH, 2004

Members received and considered the minutes of the Planning Committee meeting held on 1st March.

Minute 214 - Road Safety Working Party
Note 3.c. Recommendation (i)
Cllr Mrs Riesebeck said that she had not reported that the damaged bus sign had been repaired.

RESOLVED: that (a) minute 214 - Note 3.c. Recommendation (i) the words 'Cllr Mrs Riesebeck' be replaced with 'It was';

(b) in all other respects the minutes of the Planning Committee meeting held on 1st March 2004 be confirmed and signed as a true record.
 225. MINUTES OF THE SPECIAL PLANNING COMMITTEE MEETING HELD ON 8TH MARCH 2004

RESOLVED: that the minutes of the Special Planning Committee meeting held on 8th March 2004 were confirmed and signed as a true record.
 226. PLANNING APPLICATIONS

Members received and considered planning applications for weeks ended:

Full Application
Construction of a first floor toilet with storage space over and the installation of a sink and solid fuel stove and flue.
Taylors Yard, The Hythe, Maldon
Mr and Mrs C Cox

Cllrs S Savage and T Matthams declared a personal and prejudicial interest in the above application and left the room.

Members felt that the owners of Taylors Yard should be congratulated on the improvements that have been made to the site.

RESOLVED: that the Town Council support this application.

Works to Trees
Fell poplar tree to mitigate damage to neighbouring properties.

Crosstrees, The Downs, Maldon

Tree Warden Report - undertaken by Mrs J Good
This tree is on the boundary of the property and there appears to be subsidence to the driveway between the tree and the property concerned; subject to the Tree Officers approval

Recommended: no objection

Discussion ensued and members wondered if the subsidence damage was actually caused by the tree or by the slipping of the hill. It was suggested that the tree should be pollarded and a TPO be placed on the poplar.

RESOLVED: that the Town Council object to this application; members suggested that the tree be pollarded and a TPO be placed on the tree.

RESOLVED: that the Town Council has no objection to this application.

b. Applications received Week Ending 27th February 2004

Circulated at the meeting was a copy of the list of Planning applications received for the week ending 12th March 2004 which will be considered at the next Planning Committee meeting to be held on 29th March 2004.
 227. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 228. ROAD SAFETY WORKING PARTY

a. Notes
Members received and considered the Notes of the Road Safety Working Party meeting held 1sTMarch 2004.

Note 2 - Videos
The Chairman said that in the first paragraph, fourth line 'the construction of' should be deleted and 'in construction and repair work' be added after the word 'procedures'.

Cllr Keighley referred to the fact that the agenda stated that the notes were circulated to members only and enquired if they were available to the public to view. The Town Clerk informed members that all reports were available to the public but to save paper and postage they are not all circulated. Reference is made on all agendas to the fact that reports are available at the Town Council Offices.

Note 3(b) Accident Statistics and Traffic Calming
The Chairman referred to the legislation affecting working height and said that the legislation was in the process of changing and had not yet happened as implied in the notes of the meeting.

RECOMMENDED: that (a) the first paragraph, fourth line of Note 2 should be amended to read 'Both videos related to pavements and the correct procedures in construction and repair work that should be adopted';

(b) Note 3(b) be amended to read ……….. since the meeting there was to be a change in legislation affecting working height; the previous working height of 2 metres will be removed.

b. Attendance of County Councillor
Further to minute 214 of the Planning Committee meeting held on 1st March 2004, members noted that a response had been received from Highways and Transportation, Essex County Council stating that the dates suggested were not convenient and Councillor Bass would prefer a meeting with the entire Town Council to discuss Road Safety issues; members noted that the response would be considered at the next Council meeting.

c. Highway Repair Lists
Further to the letter of the Town Clerk dated 8th March 2004, members received the list of maintenance works to be undertaken by the Essex County Council Highways Department between 15th and 31st March 2004.

In answer to a question the Town Clerk reported that the list had been was compiled by an Officer of the Essex County Council with the aim of undertaking 'small works' and utilising surplus money before the end of the financial year. Cllr Mackenzie noted that the removal of redundant lamp posts was not included on the list and was informed that a different department was responsible for lamp posts. Members enquired as to the definition of the abbreviation DBM and it was

RECOMMENDED: that the Highways Officer, Essex County Council be contacted to ascertain the definition of abbreviation DBM.
 229. MALDON DISTRICT CONSERVATION AND DESIGN AWARDS 2004

Members received information regarding the Maldon District Conservation and Design Awards 2004, from the Conservation Assistant, Maldon District Council.

Members suggested that Oak Tree Meadow in Heybridge would be suitable to put forward for the Nature Conservation/Landscape Award and the new development at the former Does Corner was discussed as well as the Prezzo Ltd development 69-71 High Street.

RECOMMENDED: that the above item be deferred until the Planning Committee meeting to be held on 29th April 2004.

 230. EXCELLENCE ASSESSMENT OF PLANNING AND DEVELOPMENT SERVICES

Members received the above report from the Maldon District Council.

RECOMMENDED: that the information be noted.
 231. THE ESSEX COUNTY COUNCIL (MALDON DISTRICT) (PROHIBITION AND RESTRICTION OF WAITING, LOADING AND UNLOADING, ON STREET PARKING PLACES AND DISABLED PARKING PLACES) ORDER 200*

Further to minute 160 of the Planning Committee meeting held on 9th December 2003, members received and considered from the Principal Legal Assistant, Essex County Council a copy of the Public Notice relating to the above proposal which appeared in the Maldon and Burnham Standard. Members recalled that the proposals had been through the Town Council previously; not all had received the approval of the Town Council.

RECOMMENDED: that the information be noted.
 232. THE ESSEX COUNTY COUNCIL (MARKET HILL / FULLBRIDGE, MALDON) (3.5 TONNE WEIGHT RESTRICTION) Order 200*

Further to minute169 of the Planning Committee meeting held on 5th January 2004, members received and considered from the Principal Legal Assistant, Essex County Council a copy of the Public Notice relating to the above proposal which will appear where required by the Local Authority traffic Orders (Procedure) (England and Wales) Regulations 1996. Members recalled the Town Council had no objection to the proposal.

RECOMMENDED: that the information be noted.
 233. SPORTSMAN SNOOKER CLUB - 1ST FLOOR , THE OLD IRONWORKS, MALDON

Information had been received from Wortley, Redmayne and Kershaw Solicitors that an Appeal was to be made on 19th April 2004 at Witham Magistrates Court against the Maldon District Council's decision to refuse the application for a Public Entertainment Licence at the Sportsman Snooker Club.

In answer to a question Cllr Mackenzie informed members that he would not be attending the Appeal, he said he felt sure the Police and the Magistrates Court would come to the right decision.

RECOMMENDED: that the information be noted.
