MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 29th MARCH, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

In Attendance: Cllr D Keighley, Cllr Prior, the Town Clerk, the Planning Committee Clerk and two members of the public.
   The Chairman welcomed Cllrs D Keighley and W Prior to the meeting and said that they could take part in the meeting but could not vote.

 235. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 15TH MARCH, 2004

Members received and considered the minutes of the Planning Committee meeting held on 15th March 2004.

a. Minute 226.a.2 - TCA/MAL/04/00222 TCA/PN/04/00010
The Chairman reported that following a telephone call from the Tree Officer, Maldon District Council regarding the Town Council's objection to the above application he had arranged a site visit with the Tree Officer and would report at the Council meeting on the 5th April 2004.

b. Minute 228.c - Highway Repair Lists
Cllr Mackenzie enquired further regarding the redundant lamp posts around the town and the Town Clerk said that this matter would be followed up.

c. Minute 233 - Sportsman Snooker Club - 1st Floor, the Old Ironworks, Maldon
Cllr Mackenzie informed members that he had been contacted and would be accepting an invitation to attend the Magistrates Court as a witness at the appeal against the Maldon District Council's decision to refuse the application for a Public Entertainment Licence at the Sportsman Snooker Club.

RESOLVED: that the information be noted and the minutes of the Planning Committee meeting held on 1st March 2004 be confirmed and signed as a true record.

Members received and considered planning applications for weeks ended:

   Members agreed to consider item 3.a.5 of the agenda first as the members of the public were present in respect of this application.

Following a lengthy discussion it was

RESOLVED: that the Town Council objects to this application for the following reasons: inadequate consultation with neighbouring properties; inadequate access onto a busy road; overlooking neighbouring properties; F1-F6 should be moved back 6 metres to reduce overlooking to the neighbouring properties and improve visibility when exiting the development; F7,8 and 9 require obscure glass; F3 and F6 are proposed to be built onto the curtilage of a 500 year old listed building.

The above application had been amended by the submission of a revised plan.

The amendments included flat block D being moved 1.5m in an easterly direction to alterate the problems with tree roots. The bin/cycle stores had been rearranged to alleviate tree roots to T14, slight rearrangement of the car park and landscape area. Members recalled that the Town Council had no objection to this application; and had felt that a clock should be included in the High Street elevation.

A letter of objection was circulated.

RESOLVED: that the Town Council has no objection to this application.
 237. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 238. ROYAL COURT, MALDON - LOWER END

Members received and considered an e-mail from Mr Lloyd requesting that consideration be given to the installation of yellow lines, where necessary, in the lower end of Royal Court as the road was very narrow and vans and cars were causing an obstruction by parking on the bends.

Discussion ensued and it was

RECOMMENDED: that (a) the request be forwarded to the Highways Department, Essex County Council;

(b) Mr Lloyd be informed of the action taken.
 239. MALBUS 4 - LITTLE BADDOW - WOODHAM WALTER - MALDON
SERVICE 335 - BRAINTREE TO MALDON

Members received and considered information from the Strategy Liaison Officer, Passenger Transport stating that the above services would expire at the end of August.

RECOMMENDED: that the information be noted.
 240. TEMPORARY THREE WAY TRAFFIC LIGHTS BETWEEN 2 WEST SQUARE AND 1 FAMBRIDGE ROAD

Members received information and a plan from Highways, Essex County Council regarding the installation of temporary traffic lights at the above location in respect of works which commenced on 22nd March 2004.

Members reported that the temporary traffic lights had caused complete chaos with cars at a stand still on occasions when two sets of lights appeared to be on red at the same time.

RECOMMENDED: that a letter of complaint be forwarded to the Area Manager, Highways and Transportation, Essex County Council regarding the temporary traffic lights in West Square and Fambridge Road.

DESRIPTION OF DEVELOPMENT: Erection of steel gates to courtyard area between 23 and 27 Gate Street - retrospective application.

Further to minute 173 of the Planning Committee meeting held on the 5th January 2004; members received further information from the Maldon District Council regarding an appeal which had been made to the Secretary of State in respect of the above site. Members recalled that the Town Council had no objection to this application.

RECOMMENDED: that the information be noted.
 242. TRANSFER OF JUSTICES LICENCE

Notification had been received that the following had applied for a transfer of Justices Licence:

a. Mr Stewart John Swanborough and Kelly Ann Swanborough both of Hyde Way, Wickford, Essex in respect of Malones Diner, 8 High Street, Maldon;

b. Mr Kevin Thomas James of the 'Rose and Crown', 109 High Street, Maldon in respect of the Warwick Arms', 185 High Street, Maldon.
