MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 13th APRIL, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

   The Chairman welcomed Cllr W Prior to the meeting and said that he could take part in the meeting but could not vote.

 244. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 29TH MARCH, 2004

The minutes of the Planning Committee meeting held on 29th March 2004 were confirmed and signed as a true record.
 245. PLANNING APPLICATIONS

Members received and considered planning applications for weeks ended:
a. 26th March, 2004
   Members agreed to consider item 3.b.19 of the agenda first as members of the public were present regarding this application.

The Chairman adjourned the meeting to allow the members of the public to speak.

19. FUL/MAL/04/00015 MALDON WEST

Full Application

Members noted that the above application had been amended by the submission of a revised plan and recalled that the Town Council objected to this application (minute 176.a.5 referred) as it was Town Council policy to protect open spaces. The Town Council were also concerned about the Essex County Council Highway markers on the area of land.

Reconstruction of damaged sea wall in order to restore integrity, increase flood protection and provide pedestrian access to river foreshore. Construction of temporary jetties and use of land as temporary stockpile area.

RESOLVED: that the Town Council has no objection to the reconstruction of the sea wall but object to the proposed plastic elements, they felt they should be timber. Members also made the following comments: for safe navigation at night lights to be installed on the temporary pontoon; any delivery lorries to use the bypass not the High Street; the beach to be reinstated to blue flag standard and the stockpile area also to be reinstated after the work has been completed. Members also suggested the addition of a few lamps on the pedestrian walkway that would not interfere with navigation on the river.

17. FUL/MAL/03/01222 MALDON NORTH

Full Application
Redevelopment of the existing site for the erection of 53 sheltered apartments plus house managers accommodation with associated car parking and landscaping.

Members noted that the above application had been amended by the submission of a revised plan. Members recalled that the Town Council objected to this application (minute 153.a.7 referred) due to insufficient car parking and inadequate site access and requested that if the Maldon District Council were mindful to grant consent further consideration should be given to the colour of the roof tiles.

Lengthy discussion ensued regarding this application during which some members expressed the view that affordable accommodation was required within the town.

RESOLVED: that the Town Council object to this application due to insufficient car parking and inadequate site access. However, if the Maldon District Council were mindful to grant consent further consideration should be given to the colour of the roof tiles.

18. OUT/MAL/03/00944 MALDON NORTH WEST

Outline Application
Demolition of existing buildings and associated development to provide a retail park and associated development comprising non-food (A1) and restaurant uses (A3), together with associated landscaping, car parking, high ways and related works.

Members noted that the above application had been amended by the submission of a revised plan which included additional information in the form of a flood risk assessment. Members recalled that the Town Council objected to this application (minute 153.b.15 referred) as the proposed development was outside the development boundary and there were vacant brown field sites that could be used for such purposes; contrary to Policies M/NE/11 NATURE CONSERVATION and M/SH/1 SHOPPING DEVELOPMENT OUTSIDE TOWN CENTRES, in the adopted Maldon District Local Plan and Policies M/CC/2 DEVELOPMENT AFFECTING LOCALLY DESIGNATED NATURE CONSERVATION SITES AND M/SH/1 RETAIL DEVELOPMENT in the Draft Replacement Local Plan. Members felt that if the development was approved there should be a planning gain to provide a bridge crossing in Limebrook Way.

Cllr Mrs Riesebeck informed members that she felt the flood assessment report could be incorrect due to the ditch by West Station Yard being blocked and she felt further investigations should be undertaken. The Chairman suggested that Cllr Mrs Riesebeck read the document and any comments she felt relevant should be forwarded to the office for submission to the Maldon District Council.

 246. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 247. ROAD SAFETY WORKING PARTY

(a) Notes
Members received and considered the Notes of the Road Safety Working Party meeting held 29th March 2004.

Cllr Matthams informed members that he had been in attendance at the Road Safety Working Party meeting held on 29th March and it was

RESOLVED: that (i) Cllr Mackenzie's name be deleted from being present and be replaced with Cllr Mathams;

(ii) in all other respects the notes be accepted.

(b) Essex Police
Further to note 5 of the Road Safety Working Party meeting held on 1st March 2004, members were informed that notification had been received from the Essex Police advising that a representative of their Casualty Reduction Unit would be prepared to attend the meeting of the Planning Committee on Monday 26th April 2004.

RECOMMENDED: that the representative of the Casualty Reduction Unit, Essex Police be invited to attend the Planning Committee meeting to be held on 26th April 2004.
 248. MALDON DISTRICT COUNCIL - FINAL REPORT OF THE PLANNING AND DEVELOPMENT SERVICES - BEST VALUE REVIEW TEAM

Members received a report and copy of the Improvement Plan. The full report and appendices were available at the meeting.

The Chairman informed members that he had read the full report and had found it very interesting and he drew members attention to various points by reading several excerpts from the full report.

RECOMMENDED: that the information be noted.
 249. PROPOSED ADDITIONS TO THE MAIN RIVER NETWORK

Members received and considered a letter from the Regional Funding Review Implementation Manager, Environment Agency regarding the addition of the Park Drive Ditch (tidal to Mundon Road). A copy of the plan was circulated at the meeting.

RECOMMENDED: that the information be noted.
 250. STREET NAMING

Members were informed that it had been suggested that the new development at the rear of 163 Wantz Road, Maldon be named 'Horton Close' after Mr Frank Horton who had owned shops in the town.

RECOMMENDED: that a letter be forwarded to Street Naming, Maldon District Council stating that the Town Council have no objection to the new development at the rear of 163 Wantz Road being named Horton Close.
 251. IMPROVEMENTS TO MALDON'S ROAD, CAR PARK AND PEDESTRIAN SIGNAGE

Members received correspondence from Murray Foster, Town Centre Manager regarding proposed improvements to Maldon's road, car park and pedestrian signage.

RECOMMENDED: that the information be noted.

 252. ALLOCATION OF FUNDING FOR HIGHWAYS AND TRANSPORTATION 2004/2005

Members received a copy report of the Chief Planning and Development Services Officer to the Planning and Licensing Committee meeting held on 1st April 2004 regarding the Essex County Council's financial allocation for highways and transportation in the 2004/5 budget.

RECOMMENDED: that the information be noted.
 253. ROAD SAFETY WORKING PARTY

Further to minute 228.c of the Planning Committee meeting held on 15th March 2004, members noted that DBM was an abbreviation for Dense Bitumen Macadam which is a type of asphalt that can be used on footways or carriageways.

RECOMMENDED: that the information be noted.
 254. CAMPAIGN TO PROTECT RURAL ENGLAND - PLANNING UPDATE ISSUE MARCH 2004

Members were informed that the above document was available in the office.
