MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 14th JULY, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Chairman: Cllr P Roberts (Deputy Mayor)
Vice Chairman: Cllr S Savage
Councillors: Mrs. S Riesebeck, T Shrimpton,
K Smith (Town Mayor) and J Swallow.
In Attendance: The Town Clerk, Planning Committee Clerk, District Cllr Mrs. Keighley, 12 members of the public and Mr. C Tokley Chief Planning and Development Services Officer, Maldon District Council.
Absent: Cllr Mrs. V Foster
 42. APOLOGY FOR ABSENCE

An apology for absence was received from Cllr Mrs. M Curtis.


The Chairman asked members if item 10 could be brought forward as members of the Wantz Road Area Residents Group were in attendance.
 43. WANTZ ROAD AREA RESIDENTS GROUP

Members received and considered a letter from David Presswell, on behalf of the Wantz Road Area Residents Group regarding concerns about safety along Wantz Road.
(copy circulated to all members of the Council)

It was recommended that a special meeting be held with representatives of the Wantz Road Area Residents Association and Steve Broad, Highways, Essex County Council; with Essex County Councillor B Mead and District Councillor P Rew being invited to attend. Cllr Savage said that District Councillor Stichbury should also be invited and the Town Clerk informed members that she would ensure that District Cllr Stichbury was invited to attend.

The Chairman adjourned the meeting to allow the members of the Wantz Road Area Residents Group to speak.

Those in attendance expressed the view that it would be a very beneficial to have a meeting as suggested and in answer to a question the Chairman said that the meeting would be arranged as soon as possible and the residents group would be informed of the arrangements.

RECOMMENDED: that a meeting be arranged with representatives of the Wantz Road Area Residents Association and Steve Broad, Highways, Essex County Council; Essex County Councillor B Mead and District Councillors P Rew and W Stichbury to be invited to attend.


The Chairman reconvened the meeting.
 44. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 30TH JUNE, 2003

The minutes of the Planning Committee meeting held on 30th June 2003 were confirmed and signed as a true record.
 45. THE PLANNING SYSTEM - MALDON DISTRICT COUNCIL

The Chairman welcomed Mr. Clive Tokley, Chief Planning and Development Services Officer, Maldon District Council to the meeting to answer questions, offer advice and discuss the role of the Town Council with regard to Planning issues. Mr. Tokley circulated a question sheet at the meeting regarding the relationship between the Planning Services and the Town Council.

The following points were raised:

§ In the future planning application drawings could be sent electronically which could then be projected onto a screen. It was felt this would be difficult without Broadband and a paper copy would not be available for the public to view as the Town Council does not have facilities to copy large plans.

§ The District Council often disagrees with decisions made by the Town Council because the Town Council are not aware of planning policy or law. Mr. Tokley said that the role of the Town Council is to make comment and reflect the views of the community on the information they have with the application.

§ It was felt that in some cases location and block plans are not adequate as they do not clearly identify the location of the proposed application. Mr. Tokley said he would take note of this comment.

§ It was noted that some Councils allow Town and Parish Councils to speak at Planning Committee meetings. Mr. Tokley said that the Maldon District Council does not propose to allow this procedure to be adopted at District Council Planning Committee meetings.

§ Reference was made to the fact that there is at least one District/Borough Council in the Country that has delegated the determination of non controversial applications to Town/Parish Councils however, the Principle authority is still the responsible authority.

§ The question was asked as to whether there was a more comprehensive version of the District Plan. Mr. Tokley informed members that there was not but the new revised plan will be going on the District Council Website.

Mr. Tokley said he would forward further general planning information to the Town Clerk and he suggested that members might find it useful to attend District Council Planning Committee meetings he also said that if any further questions arise in the future he would be more than happy to answer them or attend another meeting.

The Chairman thanked Mr. Tokley for attending the meeting.

 47. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 48. LBC/MAL/03/00476 - TAYLOR'S YARD, THE HYTHE, MALDON

Further to minute 231.5.b of the Planning Committee meeting held on 29th April 2003, members received and considered correspondence from Mr. C Tivey, Development Control Officer, Maldon District Council regarding amendments to the above application.

RECOMMENDED: that the information be noted.
 49. STREET NAMING (PUBLIC HEALTH ACT, 1925, SECTION 17)

Further to minute 33 of the Planning Committee meeting held on 16th July 2003, members received and considered correspondence from the Street Naming and Numbering Officer, Maldon District Council regarding a proposal of 'Bramley Drive' for the site at 84-88 Cross Road, Maldon.

Further information was circulated at the meeting stating that the Post Office had expressed concern over the name of 'Bramley Drive' and as a result of this 'Braeburn Drive had now been proposed.

RECOMMENDED: that the information be noted and the Town Council has no objection to the name 'Braeburn Drive' for the site at 84-88 Cross Road.
 50. REPORTS FROM CLLR SAVAGE

(a) A report from Cllr Savage was circulated to members regarding attendance at the Renewable Energy and the Planning System meeting held on 24th June 2003. Cllr Savage said that the meeting was attended by representatives of District and County Councils but there was no representation from the Maldon District Council or the Essex County Council; he felt it was very interesting to hear the views of other planners. Cllr Savage presented the Town Council with an energy saving light bulb, canvas bag and various publications he had been given.

(b) A report from Cllr Savage was circulated to members regarding attendance at the EALC Planning Training course held on 26th June 2003.

RECOMMENDED: that the information be noted.

Cllr Savage requested that agenda item 8.b be considered before agenda item 8.a.
 51. SECTION 17 OF THE CRIME AND DISORDER ACT 1998

Further to minute 37 of the Planning Committee meeting held on 30th June 2003, members received and considered:

(a) the note following the resolution of minute 29.a.7 of the Planning Committee meeting held on 30th June 2003 as follows:

Further to the meeting the Town Clerk has made investigations with regard to the above application and Section 17 of the Crime and Disorder Act 1998. As a result of this it has been confirmed by various sources, including the Community Safety Officer, Maldon District Council that section 17 does not relate to any matters appertaining to health it is purely Crime and Disorder. The view was also expressed that if the Town Council considered Section 17 of the Act in respect of this application they should have voted in favour as the use of mobile phones etc can reduce crime.

Discussion ensued regarding the above note during which Cllr Savage reported that 6% of crimes relate to mobile phones and he also expressed the view that the text underlined was misleading and should be removed from minute 29.a.7. Cllr Mrs. S Riesebeck proposed and Cllr K Smith seconded that minute 29.a.7, remained unchanged and when put to the vote it was

RECOMMENDED: that there be no alteration to minute 29.a.7 of the Planning Committee meeting held on 30th June 2003.

(b) a further copy of Section 17 of the Crime and Disorder Act 1998;

RECOMMENDED: that the information be noted.
FOR INFORMATION
 52. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY THOMAS BATES & SON LIMITED AND BARRATT EASTERN COUNTIES

SITE AT LAND AT HALL ROAD, HEYBRIDGE, MALDON

Information had been received from the Planning Inspectorate that the Inspector's decision letter dated 4th December 2002 in respect of this appeal had been quashed by the High Court and it was ordered that the appeal be decided again.

RECOMMENDED: that the information be noted.
 53. QUESTIONS FROM THE PRESS AND PUBLIC

A member of the public enquired why item 9 on the agenda - Section 17 of the Crime and Disorder Act 1998 - stated that copies were only available for members. The Town Clerk explained that this document was large and to save paper it was only circulated to members, it states on the agenda that reports are available for inspection in the Town Council Office.

District Councillor Mrs. Keighley reported that she had found the Town and Country Planning Act 1990 very useful and felt it would be beneficial for all Councillors to have a copy.

RECOMMENDED: that the Maldon District Council be contacted to see if copies of the Town and Country Planning Act 1990 could be obtained for members of the Planning Committee.
