MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 29th SEPTEMBER, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Vice Chairman: Cllr S Savage
Councillors: Mrs M Curtis, Mrs S Riesebeck, T. Shrimpton,
K Smith (Town Mayor) and J Swallow.
In Attendance: Cllr I Mackenzie, District Cllr Mrs. B Keighley, 1 member of the public, the Planning Committee Clerk and Administrative Assistant.
   The Chairman welcomed Cllr Mackenzie to the meeting and said that although he was unable to vote he could take part in discussions.

The Chairman said that the knowledge and experience of Cllrs P Roberts and Mrs. V Foster who had recently resigned would be missed by the Committee and thanked them for their participation.
 91. ELECTION OF CHAIRMAN

Cllr S Savage was proposed by Cllr T Shrimpton and seconded by Cllr J Swallow and when put to the vote it was

RESOLVED: that Cllr S Savage be elected Chairman of the Planning Committee for the remainder of the ensuing Municipal year.
 92. APOLOGY FOR ABSENCE

An apology for absence was received from Cllr T Matthams.
 93. MINUTES/NOTES OF PREVIOUS MEETINGS

Members received and considered: (a) the Minutes of the Planning Committee meeting held on 1st September, 2003;

(b) the Notes of the Planning Committee meeting held on 17th September, 2003.

RESOLVED: that the minutes/notes of the above meetings be confirmed and signed as a true record.

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 96. ROTARY FIREWORK DISPLAY 1ST NOVEMBER 2003

Members received the following letter from the Rotary Club of Maldon:

I am writing to inform you that we have applied to Maldon District Council for the closure of the Bath Wall Footpath at the Promenade Park, Maldon from 08.30 to 23.30 hours on Saturday 1st November 2003, as this area will be used for setting up and firing the fireworks for the above display.

RECOMMENDED: that the information be noted.
 97. TOWN AND COUNTRY PLANNING ACT 1990

APPEALS BY: Thomas Bates & Sons Ltd/Barratt Eastern Counties
SITE ADDRESS: Land at Hall Road, Heybridge, Maldon
APPLICATION REFERENCE NO: FUL/MAL/0100716
APPEAL REFERENCE NO: APP/X1545/A/02/1080829

DESCRIPTION OF DEVELOPMENT: Removal of existing chalets and construction of 124 dwellings, public open space, landscaping, new highways and associated ancillary development.

Members received a letter from the Chief Planning and Development Services Officer, Maldon District Council regarding appeals by Thomas Bates & Sons Ltd/Barratt Eastern Counties which stated that "following the High Court decision to quash the Inspector's decision dated 4th December 2002 on the issue of flood risk and after further consultations with the parties involved in this appeal, the re-determination will proceed via a re-opened inquiry".

RECOMMENDED: that the information be noted.
 98. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY AIRWAVE MM02 LTD
SITE AT LAND AT WEST STATION YARD INDUSTRIAL ESTATE, MALDON, ESSEX

Members received the Inspector's decision to Dismiss the above appeal.

Cllr Savage made reference to item nine of the appeal summary which stated that the concerns of many local people about the perceived effect of the proposal upon health being a material consideration had been acknowledged.

RECOMMENDED: that the information be noted.
 99. JUSTICES LICENCE

Notification had been received that (a) Stephen Maurice Patten of The Lintons, Sandon, Chelmsford was to apply for a Transfer of the Justices Licence in respect of Saffron Restaurant & Tea Room, 9b High Street, Maldon to be held at the Magistrates Court, Witham on 13th of October 2003;

(b) John Robert Linton of Fambridge Road, Maldon, Mark Richard Hurst of Spital Road, Maldon and Robert Patrick Smith of Ashfield Farm Road, Ulting were to apply for the grant of a Provisional Justices' Licence in respect of the existing ground floor and proposed first floor of Oakhouse, 35 High Street, Maldon to be held at the Magistrates Court, Witham on 13th of October 2003.
