MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON MONDAY 29th OCTOBER, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

In Attendance: Three members of the public, District and Town Cllr W Prior, the Town Clerk and Planning Committee Clerk.
Absent: Cllrs T. Shrimpton and K Smith (Town Mayor).
   The Chairman welcomed Cllr Prior to the meeting and said that although he was unable to vote he could take part in discussions.

RECOMMENDED: that the information be noted.
 114. PROPOSED LIMITED WAITING AND DISABLED PARKING BAY GATE STREET, MALDON

PROPOSED EXTENSION TO EXISTING WAITING RESTRICTION
LONDON ROAD, MALDON

Members received and considered correspondence from Highways and Transportation, Essex County Council regarding:

(a) proposed limited waiting and Disabled Parking Bay Gate Street, Maldon;

(b) proposed extension to existing waiting restriction London Road, Maldon.

RECOMMENDED: that the Town Council has no objection to the proposals and the information be noted.
 115. PROPOSED DISABLED PARKING BAY

Members received and considered correspondence from Highways and Transportation, Essex County Council regarding proposed Disabled Parking Bays in the following locations:

(a) 48 Cross Road, Maldon;
(b) 58 Meadway, Maldon;
(c) 8 Saxon Way, Maldon;
(d) 15 St Peters Avenue, Maldon.

Cllr Riesebeck declared a personal interest in item (d) above and took no part in the discussion.

With regard to (a) 48 Cross Road - reference was made to the fact that the plan enclosed showed the location of the parking bay outside 47 Cross Road and it was requested that clarification be sought regarding this matter.

RECOMMENDED: that (i) clarification be sought regarding the location of the parking bay at Cross Road;

(ii) that in all other respects the Town Council has no objection and the information be noted.
 116. COLNE AND BLACKWATER FLOOD MANAGEMENT STRATEGY - ENVIRONMENTAL OBJECTIVES

Members received and considered correspondence from Halcrow Group Limited regarding the Colne and Blackwater Flood Management Strategy.

It was noted that there was no reference to the upper reaches of the Blackwater between Beeleigh Weir and Fullbridge in the document. The Town Clerk informed members that enquiries had been made in the past regarding this and it had been ascertained that no one seemed to be responsible for that stretch of the river. The Chairman requested that further enquiries be made.

RECOMMENDED: that (a) the consultation document from Halcrow Group Ltd be noted;

(b) further enquiries be made regarding responsibility in respect of the stretch of river between Fullbridge and Beeleigh Weir.

DESCRIPTION OF DEVELOPMENT: To erect single storey extension for use as music studio for teaching music and private use.

Members recalled that the Town Council had no objection to this application but felt that there should be an internal partition in front of the external door and appropriate sound insulation to reduce transmission of noise (minute 6(a)(3) of the Planning Committee 19 May, 2003 referred).

Members received the inspector's decision regarding the above which stated that the appeal had been dismissed.

RECOMMENDED: that the information be noted.
 118. 118. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY: Brookglade Special Projects Ltd
APPLICATION REFERENCE NO: FUL/MAL/03/00666; CON/MAL/03/00667

DESCRIPTION OF DEVELOPMENT: Demolition of redundant fire station building & existing detached house and construction of 2 new semi-detached town houses with garages and private driveway with associated external works and landscaping.

Members noted that a letter has been received from the Chief Planning & Development Services Officer, Maldon District Council stating that the above application was going to appeal and would be decided by a Planning Inspector appointed by the Secretary of State. The Town Council's representation on the above application had been forwarded to the Inspector by the District Council.

Members recalled that the Town Council had no objection to this application subject to the garages not being used for habitation (minute 85(a)(4) Planning Committee 1 September, 2003 referred).

RECOMMENDED: that the information be noted.
 119. MALDON DISTRICT REPLACEMENT LOCAL PLAN

Members received correspondence from the Planning Policy Team Leader, Maldon District Council, regarding the Maldon District Replacement Local Plan.

RECOMMENDED: that the information be noted.
 120. REPORT OF THE CHIEF PLANNING AND DEVELOPMENT SERVICES OFFICER TO THE PLANNING AND LICENSING COMMITTEE MEETING HELD ON 16TH OCTOBER 2003.

Members received copy reports regarding the following:

(a) Consideration of Telecommunications Development:

The Chairman requested that a copy of Planning Policy Guidance Note 8 - Telecommunications be obtained and also the name of the Health and Safety Officer who deals with telecommunication issues.

(b) Changes to procedures on planning applications:

The Chairman requested a copy of the Office of the Deputy Prime Minister (ODPM) circular 08/2003.

RECOMMENDED: that (i) the following be obtained: Planning Policy Guidance Note 8 - Telecommunications; Office of the Deputy Prime Minister (ODPM) circular 08/2003;

the name of the Health and Safety Officer who deals with telecommunication issues;
(ii) the reports be noted.
 121. QUESTIONS FROM THE PRESS AND PUBLIC

The Chairman adjourned the meeting for the members of the public to speak.
