MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 10th NOVEMBER, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Chairman: Cllr S Savage

T. Shrimpton and K Smith (Town Mayor).
In Attendance: Cllr D Keighley, District Cllr Mrs. B Keighley, District and Town Cllr W Prior, the Town Clerk, Planning Committee Clerk and a member of the press. District Cllr T Kelly arrived at 8.15pm,
   The Chairman welcomed Cllrs Keighley and Prior to the meeting and said that although they were unable to vote they could take part in discussions.
 122. APOLOGY FOR ABSENCE

There were no apologies for absence.
 123. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 29TH OCTOBER, 2003

Members received and considered the minutes of the Planning Committee meeting held on 29th October 2003.

Minute 115 - Proposed Disabled Parking Bay
The Chairman informed members that clarification to recommendation (i) was included on the agenda.

Minute 116b - Colne and Blackwater Flood Management Strategy - Environmental Objectives
The Chairman enquired if there been a response to this item and was informed by the Town Clerk that a response had not been received to date.

Minute 121 - Questions from the Public
The Chairman said that following a lengthy discussion with members of the public regarding an issue in Heybridge with which the Town Council were not involved, the members of the public were advised that the matter should be taken up with the Heybridge Parish Council and the District Council.

RESOLVED: that the minutes of the Planning Committee meeting held on 29th October 2003 be confirmed and signed as a true record.

Cllr Mrs. Riesebeck declared a personal interest in the above application and took no part in the discussion.

RESOLVED: that the Town Council has no objection to this application.

RESOLVED: that the Town Council has no objection to this application.
 125. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 126. WANTZ ROAD

Further to minute 76 of the Planning Committee meeting held on 18th August 2003, members received and considered a response from Stuart Jennings, Planning and Highways Support Officer, Maldon District Council.

Members were advised that the Wantz Road Residents Group would be holding another public meeting shortly. It was felt that there were many areas of the town that had similar problems to those of Wantz Road and that there should be an overall scheme for the whole town in the future.

RECOMMENDED: that the information be noted.
 127. ROAD SAFETY WORKING PARTY

Further to minute 100 of the Council meeting held on 27th October 2003, members considered the request of Cllr J Swallow for the formation of a Road Safety Working Party.

Cllr Swallow said that many people in Maldon are scared of crossing the road in the town and he felt that Maldon was not being looked after as much as it could. The Chairman felt that if a Working Party was to be formed it should be solely to discuss road safety issues as the Town Council does not have a Financial budget for the implementation of any proposals.

Cllr Keighley felt that before setting up a Working Party investigations should be undertaken with the District Council and the Essex County Council to ascertain what road safety measures there are at present. Cllr Smith informed members that numerous pedestrian crossings/islands had been requested from the Essex County Council and had been included in the Locally Determined Programme and these are waiting for funds to become available. Cllr Keighley also informed members that it was impossible to install another pedestrian crossing in the High Street to replace the one that had been removed from near the junction of the High Street and Market Hill due to restricted areas such as laybys, alleyways and the bus stops in that area of the High Street.

Cllr T Shrimpton proposed a Road Safety Working Party be set up and this was seconded by Cllr Mackenzie and carried when put to the vote.

RECOMMENDED: that (i) a Road Safety Working Party be formed comprising of;
(ii) Cllrs J Swallow, S Savage, I Mackenzie and T Matthams serve on the Working Party;
(iii) the date of the first meeting to be arranged.
 128. NOTICE OF INTENTION THAT THE MALDON DISTRICT COUNCIL PROPOSE TO DISPOSE OF LAND NEXT TO THE ROUNDABOUT EAST OF WYCKE HILL
Members received a notice which had appeared in the Essex Chronicle regarding the intention of the Maldon District Council to dispose of land next to the roundabout east of Wycke Hill.

Members felt that the disposal of this area of land would be contrary to the Town Council Policy to protect open spaces and the Maldon District Council policy to protect the landscape and it was

RECOMMENDED: that a letter be forwarded to the Solicitor, Maldon District Council stating that the Town Council object to the disposal of land next to the roundabout east of Wycke Hill for the following reasons:

§ Contrary to Town Council Policy - 'All existing and proposed "open space" sites to be protected'.

§ Contrary to Maldon District Council Local Plan 'Protection of Landscape'.

(Cllr Savage has requested that this note be included: members to note that subsequent to the meeting it was discovered that the plan on public display was different to the plan sent to the Town Council and did not show the Essex County Council boundary markers indicating two owners of the land in question for disposal.)

 129. PROPOSED DISABLED PARKING BAY
48 CROSS ROAD, MALDON

Further to minute 115 of the Planning Committee meeting held on 29th October 2003, members noted that the proposed disabled parking bay was for 47 Cross Road and not 48 as stated in the letter.

RECOMMENDED: that the information be noted.
 130. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY: Mr. S J Blyther
SITE ADDRESS: 63 Church Street, Maldon
APPLICATION REFERENCE NO: FUL/MAL/03/00354
APPEAL REFERENCE NO: APP/X1545/A/03/1121543

DESCRIPTION OF DEVELOPMENT: Erection of dormer to dwelling and erection of summer house in rear garden.

Members recalled that the Town Council had no objection to this application but expressed concern regarding the colour of the cladding and felt that black would be more in keeping with the surrounding properties (minute 210.b.5 of the Planning Committee meeting held on 31-03-03 referred).

Members received the inspector's decision regarding the above appeal which stated that the appeal had been dismissed.

RECOMMENDED: that the information be noted.
 131. PLANNING CHANGES

Members received information from the Direct Information Service (DIS), National Association of Local Councils regarding planning changes.

RECOMMENDED: that the information be noted.
 132. TRANSFER OF JUSTICES LICENCE

Notification had been received that Harold Royston Moss of 1A High Street, Maldon had applied for the transfer of Justices' Licence for the sale of intoxicating liquor of all description, in respect of the Green Pepper Restaurant, 1A High Street, Maldon.

Cllrs Keighley, T. Shrimpton, S. Savage and W. Prior declared a prejudicial interest in the above item and left the meeting. (amended at the Planning Committee meeting held on 24th November, 2003 - minute 137.(iii) refers)

RECOMMENDED: that the information be noted.
 133. CPRE PLANNING SEMINAR

Further to minute 78.2 of the Council meeting held on 15th September 2003, members received a report from Cllr Mrs. S Riesebeck regarding her attendance at the above seminar.

Cllr Mrs. Riesebeck informed members that the CPRE Planning Seminar included details of the proposed planning changes as referred to in agenda item 10 - Planning Changes (minute 131 refers) of which members had all received information from the D.I.S.

The following points were highlighted:

§ Planning Policy Guidance notes (PPG's) are subject to review and are to be re-titled Planning Policy Statements (PPS).
§ The County Structure Plan is to be abolished.
§ Third parties will have the right to appeal against planning applications.
§ Local Plans will be replaced by Local Development Frameworks.
§ The situation regarding planning gain will also change.
Cllr Mrs. Riesebeck circulated a copy of the CPRE guide to planning applications and Cllr Savage informed members that this can be downloaded from the internet.

RECOMMENDED: that the information be noted.
 134. BLACKWATER FORUM - WEDNESDAY 3RD DECEMBER 2003

Members received an invitation from Nicky Spurr, Blackwater Project Officer, Maldon District Council to attend the 1st Blackwater Forum to be held on Wednesday 3rd December 2003 at the Blackwater Sailing Club, Heybridge from 9 am to 2 pm.

The Chairman said he would attend the above Forum and it was

RECOMMENDED: that Cllr Savage attend the Blackwater Forum to be held on Wednesday 3rd December 2003 at the Blackwater Sailing Club, Heybridge.
 135. QUESTIONS FROM THE PRESS AND PUBLIC

NOTICE OF INTENTION THAT THE MALDON DISTRICT COUNCIL PROPOSE TO DISPOSE OF LAND NEXT TO THE ROUNDABOUT EAST OF WYCKE HILL

District Cllr Kelly said he was delighted that members had followed Town Council Policy to protect open spaces and suggested that the letter of objection should refer to the fact the disposal of this open space for development would have a detrimental effect and constitute an unsympathetic change upon the character of the gateway into the historic Maldon Town.

Cllr Kelly requested that members also support the objection individually and asked that they note that the deadline for objections was noon on Friday 14th November 2003.

RECOMMENDED: that the following be added to the letter of objection to the Solicitor, Maldon District Council regarding the disposal of the land at Wycke Hill:

§ It would have a detrimental effect and constitute an unsympathetic change upon the character of the gateway into the historic Maldon Town.
