MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 24th NOVEMBER, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

PRESENT: Chairman: Cllr S Savage

T. Shrimpton and K Smith (Town Mayor).
In Attendance: District Cllr Mrs. B Keighley, Cllr D Keighley, the Town Clerk and the Planning Committee Clerk.
The Chairman welcomed District Cllr Mrs. B Keighley and Cllr D Keighley to the meeting and said that although Cllr D Keighley was unable to vote he could take part in discussions.
 136. APOLOGY FOR ABSENCE

There were no apologies for absence.
 137. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 10TH NOVEMBER, 2003

Members received and considered the minutes of the Planning Committee meeting held on 10th November 2003.

(i) Minute 127 - Road Safety Working Party
Cllr Keighley informed members that he had suggested that investigations should be undertaken with the Police as well as the District Council and Essex County Council regarding existing road safety measures. The Chairman said that this will be undertaken by the Road Safety Working Party.

(ii) Minute 128 - Notice of Intention that the Maldon District Council Propose to Dispose of Land Next to the Roundabout East of Wycke Hill
The Chairman produced two plans of this area of land and explained to members that the plan on public display was not the same as that received by the Town Council and had the addition of three dots; he also stated that these were Essex County Council boundary markers on the site. It was felt that this matter had already been considered and the additional information would not change the decision. The Chairman suggested that a letter be forwarded to the District Council requesting that they ensure that the Town Council receives the same plans that are on public display. The view was expressed that this was the first time that this had happened and no further action should be taken.

(ii) Minute 132 - Transfer of Justices License
It was reported that Cllrs Savage, Shrimpton and Prior had declared a personal interest in this item.

RESOLVED: that (a) Cllrs Shrimpton, Savage and Prior be added to the declarations of interest in minute 132 - Transfer of Justices License;

(b) in all other respects the minutes of the Planning Committee meeting held on 10th November 2003 be confirmed and signed as a true record.

RESOLVED: that the Town Council object to this application as members felt a four bedroom house would be out of keeping with the surrounding properties.

RESOLVED: that the Town Council object to this application as members felt that the Belvedere was out of keeping with the surrounding properties.

Full Application
Erection of two storey side extension.

The amendment included additional plans to show the relationship between this proposal and the proposed extension at no. 58 next door.

Members recalled that at the Planning Committee meeting held on 10th November 2003 members had no objection to the above application (minute 124.b.referred).

RESOLVED: that the Town Council noted the amendment to this application.
 139. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 140. MALDON DISTRICT DRAFT REPLACEMENT LOCAL PLAN: LATEST UPDATE

Members received and considered an update from the Planning Policy Team Leader, Maldon District Council regarding the Maldon District Draft Replacement Local Plan:

(a) Report of Consultation;

(b) Revised Housing Land Supply Figures, November 2003.

RECOMMENDED: that the information be noted.
 141. WANTZ ROAD RESIDENTS' GROUP

Further to minute 126 of the Planning Committee meeting held on 10th November 2003,

(a) members received correspondence from Paul Barnes, Chairman, Wantz Road Residents Group (copy circulated to all Members of the Council);

(b) Cllr Mrs. Riesebeck informed members that she and a number of other members had attended the Public Meeting held on 19 November 2003 and it was agreed that her full report be submitted to the next Planning Committee meeting. In answer to a question members were informed that there was no action required by the Town Council prior to the next meeting and that the Residents Group were mainly waiting for County Councillor Mead to confirm certain points.

RECOMMENDED: that (a) the content of the letter from the Chairman of the Wantz Road Residents Group be noted;

(b) that the report of Cllr Riesebeck on the Public Meeting held on 19th November 2003 be deferred to the next Planning Committee meeting.
 142. RIVER BLACKWATER

(a) Blackwater Estuary Siltation Steering Group

(i) Members received the notes of the Blackwater Estuary Siltation Steering Group meeting held on 17th July 2003 (copy circulated to all members of the Council);

(ii) A report was circulated regarding the attendance of Cllr Savage at the meeting of the above group held on Wednesday 19th November 2003.

Cllr Shrimpton referred to the Pennywort problem as detailed in Cllr Savage's report; discussion ensued and members were informed that the Environment Agency were dealing with this matter.

RECOMMENDED: that the information be noted.

(b) River Blackwater - From Fullbridge To Beeleigh

Further to minute 116.b of the Planning Committee meeting held on 29th October 2003, members received correspondence from the Project Officer, The Blackwater Project enquiring as to the reasons for the Town Council's interest in the stretch of river from Fullbridge to Beeleigh (copy circulated to all members of the Council.

Members felt that a reply should be forwarded to the Blackwater Project Officer stating that the Town Council are very interested in the area as it is within the Town Council boundary and the water affects the river further downstream from the Fullbridge. Cllr Mackenzie felt that due to the erosion and siltation, gardens in this area could be at risk. Members were informed that the Riverside Association had concerns regarding the water flow and siltation in this area and the wetlands water meadow supports a number of swans.

RECOMMENDED: that a letter be forwarded to the Blackwater Project Officer stating that the Town Council are very interested in the area for the following reasons:

§ it is on the Town Council boundary
§ the water affects the river further downstream from the Fullbridge
§ due to the erosion and siltation gardens in the area are at risk
§ The Riverside Association have concerns regarding this area
§ the water meadow supports a number of swans
§ sewage comes into this stretch of river from Witham and Braintree
(amended at the Planning Committee meeting held on 9th December, 2003 - minute 152 refers)
 143. LAND EAST OF WYCKE HILL AND NORTH OF LIMEBROOK WAY, MALDON

Further to minute 128 of the Planning Committee meeting held on 10th November 2003, members received correspondence from the Solicitor, Maldon District Council regarding the proposed disposal of land East of Wycke Hill and North of Limebrook Way (copy circulated to all Members of the Council).

The Chairman read out a further letter received from the Solicitor, Maldon District Council which was in answer to a question raised by Cllr Savage regarding the ownership of the land, and the differences on the map sent to the Town Council, and the map on public deposit. The letter stated that the land in question was entirely within the ownership of the District Council and was easily identifiable on both maps. The Chairman said that he would believe this when confirmation was received from the Essex County Council.

RECOMMENDED: that the information be noted.
 144. NOTIFICATION OF PLANNING APPLICATIONS AND DECISIONS TO LOCAL COUNCILS

Members received from the Essex Association of Local Councils Guidance Note 3 - Notification of Planning Applications and Decisions to Local Councils (copy circulated to all Members of the Council).

RECOMMENDED: that the information be noted.
 145. MALDON DISTRICT BUILDING CONSERVATION PROGRAMME 2001-2004
FEEDBACK FORUM MEETING

Members received from the Conservation Assistant, Maldon District Council correspondence and notes from the previous meeting of the Feedback Forum held on 26th November 2003 (copy circulated to all Members of the Council).

The Chairman informed members that he had attended the above meeting and said that if he was available he would attend the Feedback Forum meeting to be held on 26th November 2003. Cllr Mrs. Riesebeck said that she also would like to attend the meeting if she was available.

RECOMMENDED: that the information be noted.
 146. LAND ADJACENT TO 6 WORDSWORTH AVENUE, MALDON ESSEX CM9 6BZ
REQUESTED REMOVAL OF HIGHWAY RIGHTS
SECTION 247 TOWN AND COUNTRY PLANNING ACT 1990

Members received and considered from the Area Manager South, Essex County Council correspondence and plan regarding the above (copy circulated to all Members of the Council).

The Chairman informed members that he had visited the site and had ascertained that the owner of 6 Wordsworth Avenue did not own the land adjacent to his property on which it had been requested highway rights be removed. Concern was expressed regarding two mature trees on the land and it was suggested that the views of the Tree Warden should be sought regarding the trees and the possibility of Tree Preservation Orders (TPO) being placed on them. Members felt the Town Council should object to the removal of highway rights as it is Town Council policy to protect open spaces.

RECOMMENDED: that (a) the Tree Warden be requested to look at the trees for his opinion regarding TPO Orders;

(b) a letter be forwarded to the Essex County Council stating that the Town Council object to the proposed removal of highway rights from the land adjacent to 6 Wordsworth Avenue in accordance with the Town Council's policy to protect open spaces.
 147. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY: Miss J S Nash

APPLICATION REFERENCE NO: OUT/MAL/03/00432
APPEAL REFERENCE NO: APP/X1545/A03/1131944

DESCRIPTION OF DEVELOPMENT: Proposed residential development - outline planning application with all matters of detail reserved for future determination.

Notification had been received from the Maldon District Council that an appeal had been received by the Planning Inspectorate in respect of the Councils decision to refuse planning permission for the above development. Members recalled the Town Council objected to this application as it was felt it would be over development of the site and loss of parking (minute 221.b.5 of the Planning Committee meeting held on 14-04-03 refers).

RECOMMENDED: that the information be noted.
 148. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY MRS. R M PENNY
SITE AT LAND ADJACENT 7 GRANGER AVENUE, MALDON

Further to minute 216 of the Planning Committee meeting held on 31st March 2003, members received the inspector's decision regarding the above appeal which stated that the appeal had been dismissed.

Members recalled that the Town Council objected to this application due to loss of greensward and hazardous access.

RECOMMENDED: that the information be noted.
 149. PPG 8 - TELECOMMUNICATIONS ODPM CIRCULAR 08/2003

Further to minute 120 (i) of the Planning Committee meeting held on 29th October 2003, members noted that the above documents were available in the office.
