MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 9th DECEMBER, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.
Amendments.

In Attendance: Rev Canon D Atkins, Mr. P Clarke (All Saints Parochial Church Council), Mr. G Vale (Architect), District Cllr Mrs. B Keighley, Cllr D Keighley, the Town Clerk, Planning Committee Clerk and a member of the press.
   The Chairman welcomed Canon Atkins, Mr. P Clarke, Mr. G Vale, District Cllr Mrs. B Keighley and Cllr D Keighley to the meeting and said that although Cllr D Keighley was unable to vote he could take part in discussions.
 150. PROPOSED ANNEX - ALL SAINTS CHURCH, HIGH STREET, MALDON152.

Further to minute 78 of the Planning Committee meeting held on 18th August 2003, members received a presentation from Canon David Atkins and Peter Clark regarding the proposed annex adjoining All Saints Church following the sale of the Church Hall in London Road.

Canon D Atkins introduced Mr. G Vale the Architect who had prepared the drawings and Mr. P Clark, a member of the PCC who was by profession a Quantity Surveyor. Canon Atkins reported that they were presenting the plans to the Town Council to gain feedback and then they would be submitted as soon as possible to the Maldon District Council Planning Department and the Ecclesiastical Authority for permission. He informed members that the new building had the full backing of the Church Council and it was felt that this was the way forward for All Saints Church. He understood that the location was a sensitive site in the middle of the town and in the conservation area and he stated that there had been continual consultation with the Conservation Officer, Maldon District Council and the Planning Officer. Several potential sites had been investigated by the PCC but this was the preferred location as the church and hall would be on the same site and the facilities would be available to the community in an ideally placed position in the centre of the town. It was not felt that the proposed building would detract the view of the church and this particular location would involve the least disruption within the churchyard. It was pointed out that one hundred years ago the proposed site contained a row of houses; a newspaper cutting showing this was circulated.

RECOMMENDED: that the presentation be noted and the planning application be awaited.

The Chairman thanked Canon Atkins, Mr. Clarke and Mr. Vale for attending the meeting.
 151. APOLOGY FOR ABSENCE

 152. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 24TH NOVEMBER, 2003

Members received and considered the minutes of the Planning Committee meeting held on 24th November 2003.

Minute 137 (ii)
Third line 'he also stated that there' be replaced with 'he also stated that these'.

Minute 142 (b) - River Blackwater, From Fullbridge to Beeleigh
The word 'on' of the second line in the second paragraph be replaced with 'within'. Fourth line of the second paragraph after siltation insert a comma followed by space.

Add the following to the recommendation:

§ Sewage comes into this stretch of river from Witham and Braintree.

RESOLVED: that (a) minute 137 (ii) - third line 'he also stated that there' be replaced with 'he also stated that these';

(b) minute 142 (b) - that the word 'on' of the second line in the second paragraph be replaced with 'within';

Fourth line of the second paragraph a comma, followed by a space, be inserted after siltation.

(c) Add the following to the recommendation:

§ Sewage comes into this stretch of river from Witham and Braintree.

(d) in all other respects the minutes of the Planning Committee meeting held on 24th November 2003 were confirmed and signed as a true record.

Outline Application

Demolition of existing buildings and associated development to provide a retail park and associated development comprising non-food (A1) and restaurant uses (A3), together with associated landscaping, car parking, high ways and related works.

Members recalled that at the Planning Committee meeting held on 17th September 2003 the Town Council objected to this application as the proposed development is outside the development boundary and there are vacant brown field sites that could be used for such purposes; contrary to Policies M/NE/11 NATURE CONSERVATION and M/SH/1 SHOPPING DEVELOPMENT OUTSIDE TOWN CENTRES, in the adopted Maldon District Local Plan and Policies M/CC/2 DEVELOPMENT AFFECTING LOCALLY DESIGNATED NATURE CONSERVATION SITES AND M/SH/1 RETAIL DEVELOPMENT in the Draft Replacement Local Plan. Members felt that access would cause congestion, and if the development was approved there should be left turn access only with central road barriers, there should be a planning gain to provide a bridge crossing in Limebrook Way.

RESOLVED: that the Town Council objects to this application as the proposed development is outside the development boundary and there are vacant brown field sites that could be used for such purposes; contrary to Policies M/NE/11 NATURE CONSERVATION and M/SH/1 SHOPPING DEVELOPMENT OUTSIDE TOWN CENTRES, in the adopted Maldon District Local Plan and Policies M/CC/2 DEVELOPMENT AFFECTING LOCALLY DESIGNATED NATURE CONSERVATION SITES AND M/SH/1 RETAIL DEVELOPMENT in the Draft Replacement Local Plan. Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 155. WANTZ ROAD RESIDENTS' GROUP

Further to minute 141 of the Planning Committee meeting held on 24th November 2003,

Members received a report from Cllr Mrs. Riesebeck regarding the Public Meeting held on 19th November 2003.

Cllr Mrs. Riesebeck reported on the public meeting that had been quite well attended and said that in her opinion the meeting had, at times, become quite heated but this was not the view of other Town Councillors that had been in attendance. Discussion ensued regarding the meeting and possible traffic calming measures that could be introduced in Wantz Road. It was noted that there were no firm proposals at the moment and the Chairman thanked members for their reports.

RECOMMENDED: that the reports of the meeting held on 24th November 2003 be noted and further information be awaited.
 156. RIVER BLACKWATER

(a) Blackwater Estuary Siltation Steering Group

Members received the notes of the Blackwater Estuary Siltation Steering Group meeting held on 19th November 2003;

(b) Blackwater Forum

Further to minute 134 of the Planning Committee meeting held on 10th November 2003, members received a report from Cllr Savage regarding his attendance at the Blackwater Forum held on 3rd December 2003.

It was noted that page two of the report was missing and it was agreed that the full report be circulated to members.

RECOMMENDED: that (a) the information be noted;
(b) the full report be circulated to members.
 157. STREET NAMING (PUBLIC HEALTH ACT, 1925, SECTION 17)

Members received and considered correspondence, plan and background information regarding a proposal received from Armour House Development Group Ltd to name the site rear of 99 Spital Road 'Emneth Acre'.

Cllr Mrs. Riesebeck felt that the history of Maldon could be better preserved by naming the development after Mr. Cloughton, the previous landowners grandfather rather than after a village in Norfolk or an apple. In this respect reference was made to Cyril Dowsett Court and Leslie Newnam Close which had been named after local people.

RECOMMENDED: that a letter be forwarded to the Street Naming and Numbering Officer, Maldon District Council stating that the Town Council is of the opinion that it would be more appropriate to name the development Cloughton Road/Street/Acre etc in memory of Mr. Cloughton the previous landowners grandfather.
 158. BEST PRACTISE SEMINAR - OLD HOUSE ESSENTIALS

Members received a verbal report from Cllr Mrs. Riesebeck regarding her attendance at the Best Practise Seminar - Old House Essentials, held on 13th November 2003.

Cllr Mrs. Riesebeck circulated leaflets that she had collected and reported that the seminar was the first of what was hoped to be an annual event. The meeting was very informative and provided information on grant funding, repair and maintenance of old properties.

RECOMMENDED: that the information be noted.
 159. TOWN AND COUNTRY PLANNING ACT 1990 - SECTION 247

THE STOPPING UP OF HIGHWAYS (COUNTRY OF ESSEX)(NO.14) ORDER 2003
LAND ADJOINING 7 MASEFIELD ROAD, MALDON ESSEX

Further to minute 108 of the Planning Committee meeting held on 13th October 2003, members were informed that information had been received from Go East, Government Office For The East Of England that the Secretary of State had decided to make the above order under section 247 of the Town and Country Planning Act 1990.

RECOMMENDED: that the information be noted.
 160. PROPOSED DISABLED PARKING BAYS/NO WAITING AT ANY TIME RESTRICTION

Members received and considered from Highways and Transportation, Essex County Council correspondence regarding:

(a) Proposed Disabled Parking Bays - White Horse Lane/Chequers Lane/Market Hill, Maldon;

(b) Proposed No Waiting at any time restriction - High Street, Maldon.

Members felt that the parking bay at the top of Market Hill should remain a general parking space as it was an inappropriate location for disabled parking and it is used for unloading. It was also felt that the proposed disabled parking bays at Chequers Lane should remain as general parking spaces as there were already sufficient disabled parking spaces in the area. Members were also of the opinion that the area in the High Street opposite Edward Bright Close should be kept clear as it is opposite a junction.

RECOMMENDED: a letter be forwarded to Highways and Transportation, Essex County Council stating that the Town Council object to the following disabled parking bays:

§ Top of Market Hill as it is in an inappropriate location and is used for unloading.

§ Chequers Lane should remain as a general parking space, there are already sufficient disabled parking spaces in the area.

§ High Street opposite Edward Bright Close, this should be kept clear as it is opposite a junction.
 161. TOWN AND COUNTRY PLANNING ACT 1990

Further to note 2.a.9 of the Planning Committee meeting held on 10th December 2003, members received the Inspector's decision regarding the above appeal; members recalled that the Town Council had no objection to this application.
