MINUTES OF THE TOWN COUNCIL MEETING
HELD ON MONDAY 15th DECEMBER, 2003 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

In Attendance: District Councillor Mrs. B. Keighley, Mr. Thistlewaite, Chairman, Maldon Pantomime Society, the Town Clerk, Mace Bearer, Administrative Assistant and three members of the public.
   The Mayor welcomed Cllrs. Kevin Jennings and Dennis Keighley to their first full meeting of the Town Council and extended his welcome to District Councillor Mrs. Keighley, the Chairman of the Maldon Pantomime Society and members of the public.
 110. APOLOGIES FOR ABSENCE

Apologies for absence were received from Cllrs. M. Bentley and H. Moss.
 111. PRESENTATION BY THE MALDON PANTOMIME SOCIETY

Cllr. Savage introduced Mr. Thistlewaite, Chairman of the Maldon Pantomime Society. Mr. Thistlewaite presented a framed poster of their last production, Cinderella and Cinderella 2 to the Mayor and thanked the Town Council for their continued support. This had assisted the Society in raising approximately £1,500 which had been donated to local charities including the Essex Air Ambulance.

The Mayor thanked the members of the Maldon Pantomime Society for the poster which he said would be displayed in the foyer of the Town Hall.
 112. MINUTES OF THE SPECIAL TOWN COUNCIL MEETING HELD ON 8TH DECEMBER, 2003

Members received and considered the minutes of the Special Town Council meeting held on 8th December, 2003.

RESOLVED: that the minutes of the Town Council meeting held on 8th December, 2003 be approved and signed as a correct record.

Minute 49.1 - Allotment Inspection - Warwick Crescent
Cllr. Savage stated that with regard to the inspection of the Warwick Crescent allotment site the mud had not necessarily come from the allotment site and he felt that the minutes should be amended from, "….that mud had been brought from the Lift Footpath and the allotment site onto the pavements in King Street…." to read, "…that mud had either been brought from the Lift Footpath or the allotment site onto the pavements in King Street….."

Minute 50.1 - Maldon in Bloom
With regard to note 7b - Weeds in the Town, Cllr. Savage informed members that he had recently attended an Anglia in Bloom Seminar where delegates had been informed that the absence of weeds in pavements etc. would now be taken into consideration by the judges when considering towns.

RESOLVED: that (a) minute 49.1 (Warwick Crescent) be amended to read, "…that mud had either been brought from the Lift Footpath or the allotment site onto the pavements in King Street…..";

(b) in all other respects the minutes of the Environment Committee meeting held on 17th November, 2003 be approved and signed as a correct record.

Minute 60 - Website
Cllr. Savage stated that he had also mentioned that the site was funded by commercial advertising of which the Council would have no control.

Minute 61 - All Saints' North Boundary Wall
Cllr. Keighley requested that the wording of the last sentence in the third paragraph be amended from "A member said…" to read, "Cllr. Keighley said…."

Members noted that minutes were not verbatim but, on this occasion, it was agreed to amended the minute.

RESOLVED: that (a) minute 61 - the wording of the last sentence in the third paragraph be amended to read, "Cllr. Keighley said….";

(b) in all other respects the minutes of the Finance and General Purposes Committee meeting held on 25th November, 2003 be approved and signed as a correct record.

APPOINTMENT OF MEMBERS TO SERVE ON COMMITTEES

Finance & General Purposes Committee

Further to minute 91.1 of the Town Council meeting held on 27th October, 2003 members considered the appointment of a member to serve on the Finance and General Purposes Committee for the remainder of the municipal year.

RESOLVED: that Cllr. D. Keighley serves on the Finance and General Purposes Committee for the remainder of the municipal year.

Further to minute 91.2 of the Town Council meeting held on 27th October, 2003 members considered the appointment of a member to serve on the Planning Committee for the remainder of the municipal year.

RESOLVED: that Cllr. K. Jennings serves on the Planning Committee for the remainder of the municipal year.
 115.3 Environment Committee

Further to minute 91.1 of the Town Council meeting held on 27th October, 2003 members considered the appointment of a member to serve on the Environment Committee for the remainder of the municipal year.

RESOLVED: that Cllr. Mrs. M. Game serves on the Environment Committee for the remainder of the municipal year.

APPOINTMENT OF MEMBERS TO SERVE ON WORKING PARTIES

Cinema Working Party

Further to minute 92.2 of the Town Council meeting held on 27th October, 2003 members considered the appointment of a member to serve on the Cinema Working Party for the remainder of the municipal year.

RESOLVED: that Cllr. D. Keighley serves on the Cinema Working Party for the remainder of the municipal year.
 116.2 Web Site Working Party

Further to minute 56.2 of the Town Council meeting held on 11th August, 2003 members considered the appointment of three members to serve on the Web Site Working Party for the remainder of the municipal year.

RESOLVED: that Cllrs. Mrs. Game, K. Jennings and J. Swallow serve on the Web Site Working Party for the remainder of the municipal year.
 117. WENTWORTH PRIMARY SCHOOL GOVERNOR

Further to minute 93.7 of the Town Council meeting held on 27th October, 2003 members received a letter from the Clerk of The Governors, Wentworth Primary School notifying that, due to the new framework for the constitution of school governing bodies, there was no longer a requirement to have a town councillor on the governing body and therefore the governors would not be looking to replace Cllr. Roberts.

RESOLVED: that the letter from the Clerk of the Governors, Wentworth Primary School regarding the appointment of school governors be noted.
 118. ALLOWANCES FOR TOWN COUNCILLORS

Further to minute 67 of the Finance and General Purposes Committee meeting held on 25th November, 2003 members received and considered the report of the Town Clerk regarding allowances for Town Councillors.

Discussion ensued and it was

RESOLVED: that in accordance with The Local Authorities (Members' Allowances) (England) Regulations 2003 the following notice be displayed on the Town Council notice boards for a period of at least 14 days:
   Parish Basic Allowance

1. The Town Council will continue to pay a Chairman's Allowance {Local Government Act 1972 Section 15(5)}. This allowance to be set at the Town Council Estimates meeting in December, each year.

2. The Town Council will not pay a Parish Basic Allowance to any member of the Town Council.

Parish Travel and Subsistence Allowances

1. The Town Council will pay travel and subsistence allowances, outside the boundary of the parish, including taxi fares and a bicycle allowance.

2. The Town Council will pay travel and subsistence allowances in respect of:

¨ the attendance at a meeting of any association of authorities of which the council is a member;

¨ the carrying out of any duty approved by the council, or any duty of a class so approved, or in connection with, the discharge of the functions of the authority or of its committees, sub committees or working parties.

3. The travel and subsistence allowances will be in accordance with the National Joint Council for Local Government Services.
 119. POLICE COMMUNITY SUPPORT OFFICERS PRESENTATION

Further to minute 68.2 of the Finance and General Purposes Committee meeting held on 25th October, 2003 members received and considered the report of the Town Clerk regarding the Police Community Support Officers Presentation. The report included copies of the notes of the Town Clerk and a copy of the presentation slides. Members recalled that it had been agreed at the Finance and General Purposes Committee that, although members were interested in the scheme, funds should not be included in the 2004/05 Estimates towards the provision of a Police Community Support Officer. It was felt that the Maldon District Council and other Parish Councils should be contacted to ascertain what action they would be taking regarding the provision of Police Community Support Officers.

A member expressed concern that it had been suggested by the District Council that the provision of Police Community Support Officers could be met by Parish / Town Councils as this would increase their budgets considerably.

RESOLVED: that the information be noted.
 120. PROMENADE PARK

Members received and considered a draft proposal of Cllr. J. Swallow, seconded by Cllr. D. Keighley, regarding the future operation of the Promenade Park Marine Lake. This proposal contained a draft letter which it was suggested be submitted to Maldon District Council for consideration at their meeting to be held on Thursday, 18th December, 2003 when this matter was due to be discussed.

Cllr. Prior declared a personal interest in this matter and informed members that his point of view would relate to the town rather than the District.

The view was expressed that the proposal would take away the only free water related sport in the town. It was also suggested that the letter contradicted itself as item no.2 was prohibiting paddling from the lake and the proposal was to provide a fresh water paddling pool within the confines of the lake and it was suggested that item no. 2 should read, "Swimming and diving in the lake should be prohibited".

A member stated that to keep the lake open for its current usage it would be necessary to continue with the provision of fencing around the lake, duty lifeguards etc. which would require considerable expenditure to enable limited usage of the area. Members agreed that the "picture book" aspect of the area should be maintained and felt that the installation of a proper, freshwater, paddling pool would provide this opportunity.

Concern was expressed that the proposal did not mention the provision of boating activities on the lake which had previously been available until vandals had destroyed the boats and boathouse. Cllr. Jennings said he felt that such provision could increase the revenue of the lake as well as improving the facilities offered in the park. It was therefore suggested that an additional item should be included in the proposal requesting that boating activities should be reinstated on the lake.

RESOLVED: that the draft letter submitted by Cllrs. Swallow and Keighley regarding the Marine Lake, Promenade Park be forwarded to the Maldon District Council with the following amendments:

(i) Item no.2 to read, "Swimming and diving in the lake should be prohibited".

(ii) the following additional item be included, "consideration be given to the re-instatement of paddle boat use on the lake".

PLUME BUILDING - ST. PETER'S CHURCHYARD

Plume Building - Survey

Members were informed that, as a result of recent concern regarding the appearance of cracks in the walls of the ground floor of the Plume Building and in accordance with Financial Regulation 3.4, the Town Clerk in consultation with the Mayor and Chairman of the Finance and General Purposes Committee had made arrangements for a Structural Engineer to visit the premises to view the cracks. Members noted that the cost of the visit and subsequent written report would be £250.00 plus VAT.

RESOLVED: that the information be noted.
 121.2 St. Peter's Churchyard - Funding

Members received the report of the Town Clerk indicating that a funding offer of £5,000 to assist with the refurbishment project at St. Peter's Churchyard had been received from the Essex Environment Trust. This was courtesy of Essex landfill operators all of whom contribute funds to the Trust. Trustees had also suggested that a seat would be a useful addition to the project and they were prepared to offer an additional £400 for this purpose. The offer was subject to the Town Council entering into the Trust's standard agreement or deed by Monday 5th January, 2004 and work on the project starting within 12 months of the date of their letter i.e. 19th November, 2004.

In order to comply with the legal requirement it was necessary for the Town Council to authorise the Mayor and Town Clerk to sign the Deed on behalf of the Town Council.

In response to a question regarding whether it was necessary for a solicitor to view the Deed before it was signed, the Town Clerk explained that on previous occasions when the Town Council had accepted funding from the Environment Trust, professional advice had not been taken but that there had not been any problems.

RESOLVED: that the Mayor and Town Clerk execute the deed on behalf of the Town Council and agree any minor amendments which may be necessary and execute any supplementary deeds or documents required by the deed.
 122. ESSEX FIRE AUTHORITY INTEGRATED RISK MANAGEMENT PLAN

Members were informed that an Integrated Risk Management Plan from the Essex Fire Authority had been received in the office and it was

RESOLVED: that Cllrs. Mrs. Riesebeck and Savage review the document and that Cllr. Savage compiles a report to be considered at the Town Council meeting to be held on 9th February, 2004.
 123. DISTRICT COUNCIL'S BUDGET PROPOSALS 2004/2005 - PUBLIC MEETINGS

Members received and considered a letter from the Chief Financial Services Officer, Maldon District Council notifying that public meetings were to be held on Monday, 5th January, 2004 at the Maldon District Council Chamber and on Tuesday, 6th January at Burnham Town Council Offices where the District Council's budget proposals for 2004 / 2005 would be discussed. Members were requested to consider the appointment of a representative to attend either of these meetings.

RESOLVED: that Cllr. Keighley attends the public meeting to be held at the Maldon District Council Chamber on Monday, 5th January, 2004 commencing at 7.30 p.m.
 124. ZULU

Further to minute 62.2 of the Finance and General Purposes Committee meeting held on 25th November, 2003 members considered whether the film Zulu should be shown on 25th January, 2004 to commemorate the 125th anniversary of the event.

The Town Clerk informed members that after investigation it had been ascertained that this film could only be hired in 16mm format which was unsuitable for showing on the digital projector equipment. It was suggested by a member that a personal DVD copy of the film could be shown and other members expressed the view that the film had been shown many times on television. When put to the vote it was

RESOLVED: that no further action be taken regarding this matter.
 125. ATTENDANCE AT MEETINGS

Members received the verbal report of Cllr. Prior regarding his attendance at the following meetings:

a. Maldon Community Plan 2010 Task Groups

(i) Transport and Access - 18th November, 2003 - A copy of the Transport and Access Group Draft Action Plan was circulated to members at the meeting.

(ii) Training and Education - 18th November, 2003
(ii) Environment and Planning - 19th November, 2003

b. External Bodies

(i) Maldon & South Chelmsford Primary Care Trust - Patient and Public Community Involvement - 1st December, 2003

(ii) Maldon Chamber of Trade and Commerce - 1st December, 2003

RESOLVED: that the report of Cllr. Prior be noted.
 126. MALDON PARISHES GROUP LIAISON MEETING

Members were informed that notification had been received from the Chief Corporate Services Officer, Maldon District Council regarding a Maldon Parishes Group Liaison meeting to be held on Thursday, 22nd January, 2004 at the Smythe Hall, Stow Maries commencing at 7.30 p.m. Members were advised that any items for consideration on the agenda should be submitted to the Maldon District Council offices no later than Friday, 9th January, 2004. All members of the Town Council were invited to attend this meeting.

The Town Clerk informed members that she would be submitting an agenda item regarding the formation by the District Council of a Parish Remuneration Panel.

RESOLVED: that the information be noted.
 127. COURSE - "YOU CAN PLAN FOR THE FUTURE OF YOUR VILLAGE (OR COMMUNITY)"

Members were informed that notification had been received from the Essex Training Partnership regarding a course entitled "You can Plan for the Future of your Village (or Community)" to be held on Thursday, 12th February, 2004 between 9.30 a.m. and 1.00 p.m. at the Talberd Room, Foakes Hall, Great Dunmow. The cost of the course was £24 per delegate. The course, tutored by The Rural Community Council for Essex, would cover the following items:

¨ Parish Plans
¨ Village Appraisals
¨ Participatory Appraisals
¨ Village Design Statements
¨ Identifying and Accessing Funding Sources

RESOLVED: that Cllr. T. Shrimpton attends the "You can plan for the future of your village (or community)" course to be held at Foakes Hall, Great Dunmow on Thursday, 12th February, 2004 at a cost of £24.00.

 128.2 Future Meeting Dates

Members were informed that the next two meetings of the Mid Essex Area Forum were to be held on:

Monday 19th January, 2004 at the Saville Suite, (Madison Connections), Maldon Football Club commencing at 10.30 a.m.

Thursday, 11th March, 2004 at the Waterfront, Chelmsford commencing at 2.00 p.m.

RESOLVED: that the information be noted.
 129. MALDON DISTRICT COMMUNITY SAFETY PARTNERSHIP

Members received the notes of the Maldon District Community Safety Partnership meeting held on 3rd September, 2003 and were informed that additional information was available at the meeting if required.

 130. PLANNING APPLICATION - FUL/MAL/03/01222 - 36 SPITAL ROAD, MALDON

Further to the Planning Committee meeting held on 9th December, 2003 members were reminded that a representative of the proposed developers of the above site would be attending the Planning Committee meeting on 5th January, 2004 and that all members were invited to attend.

The Chairman of the Planning Committee informed members that the Planning Committee had previously viewed this application but had not taken a vote on the matter. RESOLVED: that the information be noted.
 131. REMEMBRANCE SUNDAY

Members were informed that a letter had been received from the Hon. Secretary, The Royal British Legion thanking the Town Council for organising the Remembrance Day Wreath Laying Service at the War Memorial.

RESOLVED: that the letter from The Royal British Legion be noted.
