MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 1st JUNE, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

In Attendance: The Town Clerk, and Planning Committee Clerk.
   In anticipation of a large number of members of the public being in attendance due to the Marine Lake planning application, the meeting was held in the main hall.

No members of the public were in attendance and Cllr Savage apologised for any inconvenience caused by holding the meeting in the main hall.

 14. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 17TH MAY, 2004

Members received and considered the minutes of the Planning Committee meeting held on 17th May 2004.

The Chairman reported that a response had not yet been received from Cllr Bass regarding a suitable Wednesday or Friday for the suggested Special meeting.

The minutes of the Planning Committee meeting held on 17th May were confirmed and signed as a true record.
 15. PLANNING APPLICATIONS

Members received and considered planning applications for weeks ended:
a. 14th May, 2004
   1. FUL/MAL/04/00516 MALDON EAST

Full Application
Reconstruction of Marine Lake and Bulk Deposition of Excavated Materials.
Marine Lake Promenade Park, Park Drive, Maldon

Lengthy discussion ensued regarding the access routes for HGV vehicles; the safety of pedestrians using the park while work is in progress; the proposed depth of the water in the lake; toxicology tests and licences required from the Environment Agency and compensation to traders in the park for loss of business. Reference was also made to the changes that would occur to the Maldon Yacht Club clubhouse following the bunded deposition of sediments from the Marine Lake.

RESOLVED: that the Town Council objects to this application for the following reasons: the main entrance to the Promenade Park and the primary route (shown in red on the plan) should not be used by HGV vehicles; members felt that the material should be transported to the temporary jetties and removed by barge in preference to HGV vehicles. Where it is necessary to use HGV vehicles contractors should be instructed to use the by-pass and enter the park via the civic amenity site access road. Concern was also expressed regarding the safety of pedestrians and dog walkers using areas of the park especially where the footpaths meet with the temporary accesses and haul roads.

Members questioned the fact that a marine lake normally contains sea water and if this is the case then it should be filled with 700mm of sea water; however, if it is to be fresh water filled then it should be a maximum of 1200mm depth.

Full toxicology tests should be undertaken to show that excavated materials deposited, below the high water mark are clean and that all appropriate licenses have been obtained from the Environment Agency.

Members also noted that there was a clause in the Liveability Project which made provision for compensation of loss of business and it was felt that kiosk traders in the Promenade Park and the Viking Saga should be compensated in accordance with the clause.

Members noted that the Town Council objected to the above application due to lack of detail of the roof of the replacement conservatory (minute 245.a.1 13/04/04 referred) and that the applicant had confirmed that the roof line proposed would be pitched, in line with the Conservation Officer comments.

RESOLVED: that the Town Council has no objection to this application.
 16. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 17. PARKING PRINCES ROAD

Further to minute 261 of the Planning Committee meeting held on 26th April 2004, members received a response from the Area Manager South, Essex County Council which stated that the request for the yellow line on one side of Princes Road being replaced with a limited waiting restriction - 2 hours, no return would be investigated at the next opportunity.

RECOMMENDED: that the information be noted.
 18. PLANNING APPLICATION NO. FUL/MAL/04/00376 - PROMENADE PARK, MALDON

Further to minute 245.b.10 of the Planning Committee meeting held on 13th April 2004, members received a letter from the Senior Development Control Officer, Maldon District Council which stated that notices relating to the above application were displayed within the press and two signs had been placed at either end of the Marine Lake on 2nd April. The letter also enquired as to when the Chairman visited the area and stated that signs were normally displayed for a period of 28 days.

The Chairman informed members that he may have visited the area after the date the notices would have been removed but added that notices were not displayed at the present time regarding the Marine Lake application, FUL/MAL/04/00516, and the temporary closure of Footpath 40. The Chairman said he would be happy to visit the area with the Planning Officer and it was felt that if the notices had not been displayed for the required time the application should be re-advertised and the period of time for comments should be extended.

RECOMMENDED: that a letter be forwarded to the Planning Officer, Maldon District Council informing him (a) that planning notices regarding the Marine Lake and the temporary closure of footpath 40 were not displayed in the Promenade Park and that the Chairman of the Planning Committee would be happy to meet him on site to discuss the matter further;

(b) that if it was found that the notices had not been displayed for the required time the applications should be re-advertised and the period of time for comments should be extended.
 19. BLACKWATER SILTATION GROUP MEETING

Members received a report from Cllr Savage regarding his attendance at the Siltation Group meeting held on Wednesday 19th May 2004.

Cllr Shrimpton reported that he had been unable to attend the above meeting.

RECOMMENDED: that the information be noted.
 20. TEMPORARY CLOSURE BY ORDER - PUBLIC FOOTPATH 40 MALDON

Members received copies of the forms and plans relating to a Temporary Closure Order in respect of Public footpath 40 Promenade Park.

Members noted the temporary road closure and the Chairman reported that footpath 40 continues further through the Promenade Park and from the Boating Lake to the Delph Ditch there was no access for the disabled and it was blocked for disabled users where it meets the Civic Amenity site road. This footpath would also cross the temporary haul road which was to be constructed in conjunction with the Marine Lake and Bath Wall construction

RECOMMENDED: that a letter be forwarded to the Maldon District Council and the Essex County Council informing them that footpath 40 is blocked for disabled users at the point where it meets the road leading to the Civic Amenity site.
 21. TOWN AND COUNTRY PLANNING ACT 1990

APPEAL BY: Mr B Hedgecock
ENFORCEMENT REFERENCE NO: 78 Fambridge Road
APPEAL REFERNCE NO: ENF/1173/04/04
DESCRIPTION OF DEVELOPMENT: Erection of boundary fence (more than 2m in height).
Notification had been received that an appeal had been submitted to the Planning Inspectorate in respect of Enforcement Notice ENF/1173 - breach of planning control under Section 171A(b) of the above Act. Members recalled that the Town Council objected to this application under Section 17 of the Crime and Disorder Act 1998 as there would be a loss of light to the neighbouring property and main entrance.

RECOMMENDED: that the information be noted.
 22. JUSTICES LICENCE

Notification had been received that Mr R H A Wint of Dickens Drive, Laindon, Basildon and Mr P Camilleri of 162-164 High Street, Maldon were to apply for a Restaurant Licence in respect of Marcella's 162-164 High Street, Maldon. Members noted that the premises were previously licensed but the licence was allowed to lapse.

RECOMMENDED: that the information be noted.
 23. PUBLIC ENTERTAINMENT LICENCE

Notification had been received that Jacqueline Barbara Short of the East Essex Adult Community College had applied for an Entertainment Licence for the main hall of the Friary, Carmelite Way, Maldon Essex.
