MINUTES OF THE PLANNING COMMITTEE MEETING
HELD ON TUESDAY 28th JUNE, 2004 AT 7.30 P.M.
IN THE CONFERENCE ROOM, TOWN HALL.

and the Planning Committee Clerk.
   The Chairman welcomed Cllr Prior to the meeting and said he could take part in the discussions but could note vote.

 34. MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 14TH JUNE, 2004

Members received and considered the minutes of the Planning Committee meeting held on 14th June 2004.

Minute 27 - List of Maldon District Council Planning Decisions
The Chairman informed members that pedestrian movements, as referred to in planning application FUL/MAL/03/00030 - Quest Motors, 127-129 High Street, along Butt Lane had been considered earlier during the evening at the Road Safety Working Party meeting.

The minutes of the Planning Committee meeting held on 14th June were confirmed and signed as a true record.

3. FUL/MAL/04/00626 MALDON NORTH

Full Application
Redevelopment of the existing site for the erection of 54 sheltered apartments plus house managers accommodation with associated car parking and landscaping.

RESOLVED: that the Town Council object to this application due to insufficient car parking and inadequate site access and members felt that the removal of the hipped ends was retrograde to the application. However, if the Maldon District Council were mindful to grant consent further consideration should be given to the colour of the roof tiles. Members also expressed concern that the application does not conform to Policy T3, note 4 of the Essex & Southend-on-Sea Replacement Structure Plan 1996 - 2001 which states that the applicant is required to provide a comprehensive Transport Impact Assessment and to demonstrate how the transport needs of the development can be accommodated whilst maintaining or improving road safety and the surrounding environmental conditions for the local community; in this respect it was noted that local bus services are proposed to be reduced making travel outside of the town difficult.

The amendment was a reduction in the height of the gates and railings. Members recalled that the Town Council Planning Committee had no objection to this application (minute 26.a.6. referred, Planning Committee meeting 14/06/04)

RESOLVED: that the Town Council noted the amendment to this application.
 36. LIST OF MALDON DISTRICT COUNCIL PLANNING DECISIONS

Members received the list of Maldon District Council Planning Decisions.

RECOMMENDED: that the information be noted.
 37. MALDON DISTRICT DRAFT REPLACEMENT LOCAL PLAN - INSPECTORS REPORT

Members received a verbal report from Cllr Prior on the Inspectors Report regarding the Maldon District Draft Replacement Local Plan, Maldon District Council.

Members were reminded that Mr J Doe, Planning Policy Manager, Maldon District Council would be reporting on the Inspectors report at the Council meeting to be held on 5th July 2004.

Cllr Prior said that he did not have a copy of the press release and gave a brief report on the following key issues in the Inspector's report:

· the proposed relocation of the District Council Offices to the rear of the Blackwater Leisure Centre had been refused as it was felt that the District Council Offices should be located in a central position accessible to all.

· a retail park should be located either somewhere within the boundary of Maldon town or within the District for people that cannot travel further distances to shop for larger items.

· given the size of the town and to retain its character 10 additional hectares of land should be made available for business units in Maldon and Heybridge from either brown field or new sites.

· Sadds Wharf requires development for mixed use; residential, retail and business.

· the District Council were criticised for not complying with government policy to reduce car parking and additional car parking in the town was rejected as people should be encouraged to use public transport.

· there was a need to improve access to local railway stations and new developments should be located in areas with poor transport as developers could contribute to transport improvements.

The Chairman thanked Cllr Prior for the report and enquired if members felt a special meeting would be necessary to discuss this further and it was

RECOMMENDED: that consideration of holding a special meeting be deferred until after the Council meeting at which Mr J Doe Policy Manager, Maldon District Council would be speaking on the Inspector's Report.
 38. REQUEST FOR LIMITED WAITING RESTRICTION - PRINCES ROAD, MALDON

Further to minute 17 of the Planning Committee meeting held on 1st June 2004, members received and considered a response from the Area Manager South, Highways, Essex County Council regarding the request for a limited waiting restriction in Princes Road, Maldon.

Members agreed with the suggestion that consideration should be given to limiting the waiting times on the un-adopted section of the road north of the entrance to the Council Offices. It was noted that this section of road is owned by the doctors surgery and with their permission a TRO could be introduced to stop all day parking and create a greater turnaround of vehicles.

RECOMMENDED: that the Highways Department, Essex County be informed that the Town Council agree with the proposal to limit the waiting times on the un-adopted section of the road north of the entrance to the Council Offices and that they be requested to negotiate with the doctors for a TRO to be introduced.

 39. BLACKWATER ESTUARY SILTATION STEERING GROUP

Members received the minutes of the Blackwater Estuary Siltation Steering Group meeting held on 19th May 2004.

The Chairman brought to members attention Note 4 of the minutes and referred to the notes on page 2 detailing discussions which had taken place after the meeting with Agency Officers regarding the dredging involved in respect of refurbishment of the marine lake. It was noted that the date of the next meeting was Wednesday 21st July 2004.

RECOMMENDED: that the information be noted.
 40. TEMPORARY SIGNALS - WEST SQUARE / SPITAL ROAD / FAMBRIDGE ROAD

Copies of the details regarding the above temporary signals were circulated to all members as the signals were already in operation.

The Chairman said that he had been informed by Mr Broad, Highways, Essex County Council that the temporary signals at West Square / Spital Road and Fambridge Road would for a short time operate for 24 hours per day. Cllr Curtis said she had also noticed signs that work was to commence on resurfacing the bypass.
